During an NRC inspection conducted on October 6,1998 through November 23,1998, a 4
violation of NRC requirements was identified. In accordance with the " General Statement
{
of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

l License Condition C (3), Fire Protection, of Facility Operating License DPR-65, for the Millstone Unit 2 Nuclear Power Station, states, in part, "The licensee shall implement and maintain in effect all provisions of the approved fire protection program as described in the Final Safety Analysis Report and as approved in the j
Safety Evaluation Report dated September 19,1978, and supplements dated October 21,1980, April 29,1988, July 17,1990, and November 3,1995".
l Safety Evaluation Report dated October 21,1980, section 3.2.4, states, in part,
" fire barrier penetration materials used meet the ASTM E-119 Fire Endurance Test and have been installed as three hour fire seals".
Contrary to the above, the licensee did not implement and maintain in effect all i
provisions of the approved fire protection program as indicated by the following examples.
1.
On or before November 20,1998, conduit 915,in fire area A-24, was not sealed and tested in accordance with ASTM E-119, Fire Endurance Test, and the configuration did not meet the required three hour fire rating, in that, the conduit was sealed internally with a very hard, dried "Duxueal*" like material.

This materialis not tested and approved in accordance with ASTM E-119.
2.
On or before November 20,1998, repairs were made to 18 fire barrier seal penetrations that resulted in the seals being in a configuration that was not tested or evaluated. Specifically, the repaired seal configurations were neither tested in accordance with the ASTM E-119 Fire Endurance Test nor evaluated to have a three hour fire rating.
This is a Severity Level IV Violation (Supplement 1) for Docket No. 50-336.
Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the receipt date of the letter 9901190034 990107 PDR ADOCK 05000336 G

transmitting this Notice of Violation (Notice). This reply should be clearly marked as a
" Reply to a Notice of Violation" and should include for each violation: (1) the reason for l
the violation, or, if contested, the basis for disputing the violation or severity level, (2) the l
corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Your response may reference or include previous docketed correspondence, if the correspondence adequately addresses the required response if an adequate reply is not received within the time specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or i
why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
If you contest this enforcement action you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.
