Dear Sir or Madam:
This letter constitutes ARCO's response to the Notice of Violation issued by the Nuclear
' Regulatory Commission on May 12,1999. The Notice of Violation resulted from the L
. inspection of the Roy F. Weston facility used to store and receive ARCO Nuclear Medical Products Company pacemakers after they are explanted from patients. The Notice of Violation referenced a single violation. ARCO 's Nuclear Materials License (SNM 1993) authorizes two Roy F. Weston employees, Richard Shimko and Patrick Rafferty, to store the licensed material (pacemakers). Richard Shimko is identified as the radiation safety officer.
Both Mr. Shimko and Mr. Rafferty left Roy F. Weston's employ during 1998. Weston notified ARCO of this fact, but because of an internal oversight, ARCO's license amendment was not submitted to the NRC.
In order to comply with the terms ofits license, ARCO has prepared and will submit a NRC
' Form 313 to amend SNM 1993. The amendment request reflects the replacement of Mr.
Shimko and Mr. Rafferty with Laurence F. Smith and Robert Massenirill. Both Mr. Smith and Mr. Massengill will receive and store the licensed material. Mr. Massengill will serve h
as the Radiation Safety Officer. A copy of the Form 313 and attachments will be forwarded
/g to your attention as soon as they are complete.
Finally, ARCO is in the process of being acquired by British Petroleum, P.L.C. As soon as is practicable, ARCO will submit an application for a Change of Ownership of the lice i
. material.
