Fee Waiver request for attached Freedom of Information Act request Dear Mr. Chilk This letter is a request for a full fee waiver of any processing, search, or duplication costs incurred by the Nuclear Regulatory Commission (NRC) in fulfilling the attached Freedom of Information Act (FOIA) request.

We are aware of the NRC's guidelines for a fee waiver contained in 10 CFR 9.41, and we believe we satisfy those requirements.

Below are listed the criteria contained in 10 CFR 9.41(b), coupled with our response fulfilling each of those criteria.

(b) "A person requesting the NRC to waive or reduce search, review, or duplication fees shall:

(1) Describe the purpose for which the requester intends to use the requested informations" Public Citizen will use the information in a study on the level of safety of commercial nuclear power plants in the United States for the year of 1987.

(2) "Explain the extent to which the requester will extract and analyze the substantive content of the agency records" We will either use the raw data asked for in the request in a "verbatim" f ashion, or we will use it as the basis for statistice.1 analyses.

(3) "Describe the nature of the specific activity or research in which the agency records will be used and the specific qualifications the requester possesses to utilize information for the intended use in such a way that it will contribute to public understanding;"

commercial nuclear power plants in the United States for the year of 1987.

Public Citizen's Critical Mass Energy Project is a nationally kncwn non-profit public interest organization founded in 1974.

We have been preparing studies based on NRC and Atomic Energy Commission documents since our founding.

We plan to broadly disseminate the information contained in the agency records to the press, government officials, and the general public.

Our past publications have attracted attention in the local, national, and trade press, and thousands of copies have been distributed.

The person who will be doing most of the work on this particular study is trained as an energy policy analyst specializing in nuclear plant safety issues.

(4) "Describe the likely impact of the public's understanding of the subject as compared to the level of understanding of the subject existing prior to disclosure;"

The public's understanding of the subject is likely to be increased as these records have not been previously released to the public, and we will widely disseminate the information contained therein.

The public's concern about nuclear power plant safety was enhanced first by the accident at Three Mile Island in 1979 and again by the Chernobyl accident in 1986.

Our dissemination of the information contained in the requested records will give the public a more accurate understanding of the safety records of individual nuclear power plants throughout the country and the industry as a whole for 1987.

(5) "Describe the size and nature of the public to whose understanding a contribution will be made;"

Government officials, members of the press and broadcast media, citizens living in the vicinity of nuclear power plants, citizens concerned about the safety of nucicar power, and the general public will gain a better understanding of the level of nuclear power plant safety attained in the United States in 1987.

(6) "Describe the intended means of dissemination to the general public;"

The information will be disseminated in the form of published arts, press releases, personal interviews, and news stories in the

Public Citizen also publishes its own magazine, with a d

circulation of over 50,000.

The information contained in the requested records will also be used in articles for Public Citizen magazine.

Also, the information will be disseminated by means of periodic mailings to over 850 citizen groups and individual activists who are working on nucicar safety issues -- many of whom will further distribute the information to their members and local press.

(7) "Indicate if public access to information will be provided free 1

of charge or provided for an access fee or publication foe;"

At least several hundred copies of our study will be made available 2

g free of cha.rge to the media, citizen activists, and government officials.

The public will also have free access to the information through the press and through personal interviews.

A small publication fee will be charged to other interested parties.

We have no commercial or private interest in the records sought.

Public Citizen is a not-for-profit educational corporation; we have a 501(c)(3) tax status.

We believe that we satisfy the criteria for a fee waiver established both by the Freedom of Information Act and the NRC's own regulations.

Consequently, we request a full waiver ei all processing, search, and duplication fees incurred by the Nuclea7 Regulatory Commission in filling the attached FOIA request.

If you require further information as f.o why we are entitled to a fee waiver, please let us know.

We will expect a reply to this fee waiver request with your response to the attached FOIA request within the ten working days provided for in the Freedom of Information Act.
