Dear Mr. Chairman:
I am writ'ng to clear up a misunderstanding which developed, and to which I may have contributed, at yesterday's hearing before your Committee.
At the hearing, Congressman Miller asked a question regarding opportunities for public comment i
in our proceedings on the Diablo Canyon quality assurance program.
That question, as I now understand it, focused specifically on whether there would be an opportunity for comment by the parties on the results of the audit itself.
Upon returning from the hearing, the General Counsel researched the matter and determined that while the relevant Commission order provided for a comment period on the proposed auditor, and on the proposed program plan, it did not provide for comment on the audit itself.
The Commission, of course, may ultimately choose to ask for comment, but it has not yet decided to do so.

I hope this clears up any misunderstanding that may have arisen regarding this matter.
