Dear Mr. Quinn:
This will acknowledge receipt of your letter dated June 26,1997 and your payment of
$205,000 for the civil penalty proposed by NRC in a letter dated May 27,1997. Your corrective actions will be examined in future inspections.
In your correspondence, you disagreed with the violation not assessed a civil penalty, stated in Section ll.B of the May 27,1997 Notice of Violation and imposition of Civil Penalties (Notice). Based on the information you provided,.we agree that the June 22, 1995 letter from Westinghouse, regarding postulated intrusion of grit in the secondary side of the steam generators and its affect on those components, was not procured as a safety evaluation, and therefore the procedural requirements of station administrative order (SAO)-460 did not apply. Therefore, the violation is retracted.
However, we do note that the information in the Westinghouse letter was used in the closure of the Open Item Report (OIR) that documented the June 1995 heater drain tank pump failure and the identification of grit in the feedwater system. Specifically, the information in the letter was used to support the conclusion that there was no impact on the safety related stet.m generators as a result of the grit intrusion. As such, we considered this to be an analysis supporting continued operability of the steam generators and thus merited proper review by Con Edison. The NRC considers that the deficiencies in your evaluation of the scope and impact of the grit intrusion, which caused the June 1995 heater drain pump event, contributed to the inadequate corrective action measures for which the NRC imposed a violation with civil penalty in Section I.A.(1) of the May 27,1997 Notice. Your response of June 26,1997, acknowledged the concerns and agreed to our evaluation of the circumstances surrounding that violation. Furthermore, we note that you have made changes to your process for performing evaluations of degraded plant conditions. in response to this and subsequent plant events, to ensure more rigorous and formalized operability t{g O determinations.
