In coyhection with our review of three pending export license applications (XSt(W-1725,1726, and 1727) for fuel for the ASTRA research reactor in Austria, it has come to our attention that the Government of Austria has not provided a written assurance regarding the levels of physical protection to be provided U.S.-origin nuclear materials in Austria, as is required by our expor: regulations.

(Such an assurance was provided in connection with XSfN-1428, but the assurance was specific to that export license.)

I would appreciate your seeking these assurances from the Austrian Government.

As you know, we consider as equally acceptable either (1) assurances with respect to the material covered by individual license applications, (f) assurances with respect to U.S.-origin material at a particular facility, or (3) assurances with respect to all U.S.-origin material which the country possesses or will possess.

Condition 2 - Exports authorized in any country or destination, except Country Groups Q, S, W, X, Y, and Z in Port 370, Supplement No.1, of the Comprehensive Export Schedule of the U.S. Department of Commerce.

Condition 3 - This license covers only the nuclear content of the material.

Condition 4 - The material to be exportea under this license shall be shipped in accordance with the physical protection reovirements for special nuclear material in 10 CFR 73.

Condition 5 - Special nuclear matenal authorized for export under th's license shah not be transported outside the United States in possenger carrying circraft in shipments exceeding (1) 20 grams or 20 cunes, whichever is less, of plutonium or urnnium 233, or (2) 350 grams of uranium 235.

Condition 6-This license authorizes edert only and does net authorize the receipt, phys. col possession, or use of the nuclear material.

Condition 7 - The licensee shall complete and submit on NRC Form 741 for each shipment of source material exported under this license.

Condition 8 - The licensee shall advise the NRC in the event there is any change in the designc.

Condition 9 - The material to be exported under this license shall be protected in transit, while within U.S. jurisdiction, in accordance with the requirements of 10 CFR 73 and the licensee's approved security plan.

Condition 10 - The licansee shall not deliver formula quantities of' strategic special nuclear material to any carrier for transport until such carrier has submitted to the NRC a physical security plan in response to the requirements of 10 CFR 73.20, 73.25, and 73.26.
