Docket No. 50-346-ML Dear Judge Hoyt On March 2, 1986 -- prior to your March 10, 1986 Memoran-dum and Order -- Mr. Lawrence J. Lucas wrote to the NRC regard-ing "giv[ing) testimony of a limited nature" with respect to the burial of very low level radioactive waste at the Davis-Besse site.

Mr. Lawrence did not identify any issues in his March 2 letter, and he did not thereafter file a petition for leave to intervene in response to your March 10 Memorandum and Order.

The Toledo cdison Company construes Mr. Lucas' request to give testimony of "a limited nature" as a request to make a limited appearance statement.

The March 10 Memorandum and order required pers.ons who wished to become a party to identify particular deficiencies in Toledo Edison's application, to pro-vide specific citations, to provide detailed discussion of each deficiency alleged, and to support each allegation with data, materials, or references.

Mr. Lucas has not met these require-ments.

The March 10 Mer.orandum and Order further provides that the submittals of a person whom the Presiding Officer deter-mines should not be made a party will be treated as a limited appearance statement.

Accordingly, Toledo Edison respectfully submits that Mr.

Lucas' letter should be accepted by the Presiding officer as a limited appearance statement.
