ANNUAL REPORT ON COMMISSION AD ICATION
Purpose:
To provide the Commission a perspective on the adjudicatory caseload and the Commission's role in adjudication from January through December 1996.

Introduction:==
The Commission alone is authorized to review the decisions of presiding officers and Atomic Safety and Licensing Boards in agency proceedings.
The Office of Commission Appellate Adjudication assists the Commission in this adjudicatory role.
The Commission may exercise its appellate' authority to review Licensing Board decisions either when a dissatisfied party to an NRC adjudicatory proceeding seeks review or when the Commission, on its own initiative, determines that review 3e appropriate.
The Commission also has original jurisdiction to offer guidance to the Licensing Board on significant novel questions raised in a proceeding.
As part of OCAA's monitoring role over adjudicatory matters, I am providing the Commission this report on agency. adjudications for calendar year 1996.
This report updates information contained in the last report (SECY-96-164,rJuly 23, 1996) and is based on the information compiled in the attached charts.
Discussion:
A.
General Obserystions and Trends The Licensing Board's workload rose in 1996, as measured by the number of its final decisions (17, 8,
14, 13, and 19 in 1992, 1993, 1994, 1995, and 1996, respectively).

contrast, the commission's own adjudicatory workload declined somewhat, as measured by the number of significant commission decisions issued during those same years (22, 26, 16, 17, and 13 J
respectively).
See Chart 6.
Over the past 5% years, the Commission has referred 68 adjudicatory proceedings to the Licensing Board.
The number of proceedings referred to the Board in 1996 (9) is somewhat less than the average number (13) for the previous four calendar years (18, 11, 20 and 4 new proceedings referred in 1992, 1993, 1994, and 1995, respectively).
It is hard to pinpoint any particular reason for either this sawtooth pattern in the number of referrals or the elight overall decline in new proceedings.
These may reflect merely a fluctuation in caseload or may reflect a diminution in Commission licensing and enforcement activity.
l Enforcement disputes continue to dominate the adjudicatory caseload.
Challenged enforcement orders have consistently accounted for about half the referrals to the Board for each of the past four years.
The next largest categories of adjudications for that same period involves materials licensing cases and reactor licensing proceedings, each representing 18 percent.
Looking at the last four years, the 44 new proceedings can be catalogued as follows:

2 Most proceedings and well before a final decision on the merits, generally after a settlement agreement.
Two significant cases terminated this year following a settlement -- oncoloav Services.
Corn. and Radiation Oncoloav Center at Marlton, two related civil penalty enforcement proceedings stemming from the fatal over-exposure of a nursing home patient.
In addition, three other enforcement cases settled -- Eastern Testina and Inspection.
Inc., Juan Guzman, and James L.
Shelton / Testco. Inc.
Similarly, four reactor licensing proceedings were terminated because one party (either the licensee or the sole intervenor) either withdrew or failed to file the required pleadings -- Gulf States Utilities Co. (River Band), Northeast Nuclear Enercy Co.
(Millstone), Georaia Power Co. (Voatle), and Washincton Public i
Power Sunolv System (WPPSS No. 3).
OCAA expects that, in the near future, enforcement proceedings will continue to constitute the lion's share of the adjudicatory i

l program.
In these enforcement proceedings, the Commission may see an increase in the number of hearings challenging enforcement orders' immediate effectiveness.
The Commission since 1992 has permitted licensees to challenge not only the underlying basis for an order modifying, suspending, or revoking a license, but also the order's immediate effect.
Under 10 C.F.R.
$ 2.202(c),
I the Commission provides for an expeditious, preliminary hearing to assure that the staff had at least minimally " adequate evidence" for its immediate action.
In 1996, the Licensing Board conducted two such hearings in Eastern Testina and Insnection.

B.
Adjudications in 1996 1.
commission Decisions As shown in Chart 1, the Commission in the last year issued thirteen substantive decisions.
The following seven of these decisions responded to appeals or petitions for review of Licensing Board orders:
o CLI-96-3, Seauovah Fuels Coro, and General Atomics The Commission granted the intervenors' petition for review of a Board order, LBP-95-18, approving a settlement agreement between the NRC staff and Sequoyah Fuels.
The intervenors in this proceeding are Native Americans for a clean Environment (NACE), and the Cherokee Nation; the Commission has permitted the state of oklahoma to file an amicus curiae brief.
o CLI-96-4, Cleveland Elec. Illuminatina Co.
The Commission granted Cleveland Electric's petition for review of a Board order, LBP-95-17, which found that changes to the licensee's withdrawal schedule for reactor vessel surveillance capsules constitute material licensing actions and therefore require a license amendment and hearing.
(The Commission subsequently issued CLI-96-13, reversing and vacating the Board's decision.)
o CLI-96-7, Yankee Atomic Elec. Cox --
The Commission reviewed on appeal a Board order, LBP-96-02, denying the petitioners' request for a hearing on the licensee's planned decommissioning activities.
The Commission largely affirmed the Board decision, but remanded two issues: whether a "new-dose" argument raised on appeal satisfies agency requirements for late contentions, and whether the same argument is sufficient for an

ALARA or NEPA challenge to the licensee's decommissioning plan.
o CLI-96-8, Louisiana Enerav Services -- The Commission ruled that the on-site fire brigade's role, size and training were issues material to the Board's basic finding on emergency planning, and that the Licensing Board in LBP-96-7 had therefore erred in leaving these matters for the NRC staff to resolve outside the adjudicatory process.
However, rather than remand the issue to the Board, the Commission itself resolved the matter, clarifying the role of.the fire brigade and finding that, givsn this clarification, the LES emergency plan description of the brigade met the Commission's emergency plan requirements.
o CLI-96-9, Yankee Atomic Elec. Co. -- The Commission refused to review a Board decision, LBP-96-18, granting licensee's motion for summary disposition in this decommissioning proceeding.
The Commission concluded that the petition raised no substantial questions meriting review.
Intervenors have chosen not to appeal the Commission's decision to Federal court.
o CLI-96-11, Emerick S. McDaniel -- Mr. McDaniel sought review of LBP-96-17 in which the. Presiding Officer had denied Mr. McDaniel's challenge to the NRC staff's rejection of his claim that he had passed the examination to become a reactor operator at the Vogtle plant.
The commission denied his Petition for Review because it failed to raise any substantial question meriting Commission review.
o CLI-96-13, Cleveland Elec. Illuminatina Co. -- The commission reversed and vacated a Licensing Board order, LBP-96-17, which had ruled that the approval process under 10 C.F.R. Part 50 for changes to a licensee's reactor vessel surveillance capsule withdrawal schedule violates the notice and hearing provisions of section 189a of the Atomic Energy Act (AEA).
Although the commission agreed with the intervenors that Appendix H requires prior NRC approval of any change to a withdrawal schedule, the Commission nevertheless concluded that the prior approval did not constitute a license amendment under the AEA.
In addition, the commission issued two decisions pursuant to its original jurisdiction, and one decision sua soonte -- all in the Yankee Rowe proceeding:
o CLI-96-1, Yankee Atomic Elec. Co. -- The Commission referred the petitioners' request for l

hearing and intervention to the Licensing Board, and provided the Board with guidance on issues of standing, occupational exposure, and decommissioning.
o CLI-96-5, Yankee Atomic Elec. Co. -- The Commission denied the petitioners' request that Chairman Jackson, Commissioner Rogers, and the NRC staff all be disqualified from further j
participation in the proceeding.
The Commission also reaffirmed its earlier guidance (provided in CLI-96-1) on occupational exposure and choice of i
decommissioning options.

CLI-96-6, Yankee Atomic Elec. Co.
Commission on its own motion reviewed and sustained two Director's Decisions, DD-96-1 and l
DD-96-2, denying the petitioners' request for immediate enforcement action.
In their motion for emergency Commission action, the petitioners had alleged that the licensee was conducting
)
unauthorized decommissioning activities.
The Commission also issued one decision addressing an appeal as of right from a decision of the now-defunct Atomic Safety and Licensing Appeal Board:
o CLI-96-2, Kerr-McGee Chem. Coro. -- The Commission granted Kerr-McGee's motion to terminate this long-suspended proceeding as moot, and vacated the chal3enged yet unreviewed underlying decision, ALAB-944.
This proceeding involved a challenge by the State of Illinois and the City of West Chicago to Kerr McGee's application to dispose of mill tailings on-site at its West Chicago Rare Earths facility.
All parties agreed that this proceeding is moot because Kerr-McGee no longer intends on-site disposal of its wastes.
Illinois and West Chicago, however, have appealed the Commission's decision to Federal court and are expected i
to argue that the commission erred in vacating ALAB-944.
The Federal case is currently held in abeyance pending settlement negotiations between Illinois and Kerr-McGee.
Finally, the commission issued two decisions on challenges to the certification of the U.S.
Enrichment Corporation's facilities in Piketon, Ohio and Paducah, Kentucky:
o CLI-96-10, U.S. Enrichment Coro. -- The Commission considered four petitions for review of a Director's Decision approving certificates of compliance for the United States Enrichment Corporation's gaseous
6 diffusion plants.
The Commission denied two petitions for review for failure to meet the requirements of 10 C.F.R. Part 76, but referred those petitions to the NRC staff for its own review and response.
Concluding that only those parties who had participated in the initial comment stage of this proceeding could petition for review of the Director's Decision, the Commission denied a request that any " interested party" be allowed to file a petition for review.
o CLI-96-12, U.S.
Enrichment Corn. -- The Commission denied reconsideration of CLI-96-10,. rejected the remaining petitions for review, and referred various matters to the NRC staff for reviev.
2.
Adjudioatory Matters currently 2ending Before the Commission At the end of 1996, four Board decisions in two proceedings remained under active Commission review:
o Seouovah Fuels Corn. and General Atomics, LBP-95-18 and LBP-96-24.
The Commission is considering challenges to the Board's approval of settlement agreements between the NRC staff and the Sequoyah Fuels Corporation (SFC),
and also between the staff and SFC's parent, General Atomics (GA).
The proceeding stems from a staff enforcement order holding SFC and GA jointly and severally responsible for the decontamination and I
decommissioning of SFC's facility near Gore, Oklahoma.
Petitioners challenge the SFC settlement's provisions exempting SFC from certain funding requirements.
The staff and SFC respond that the settlement is a favorable arrangement because SFC has agreed to commit all of its present and future assets and revenues to clean up the SFC facility.
The petitioners object that the GA settlement fails to ensure that GA will commit sufficient resources to decontaminate and decommission the Gore facility and that it is therefore not in the public interest.
Staff and GA disagree.
The Commission in 1996 granted the petition for review regarding the SFC settlement and in early 1997 granted a similar petition regarding the GA settlement.
The Commission is currently awaiting briefs on the GA settlement.

This proceeding involves the Louisiana Energy Services's (LES) i application for a license to construct and operate the l
Claiborne Enrichment'Conter, near Gore, Oklahoma.
The i
license would permit LES to enrich uranium by a gas centrifuge process.
I The Licensing Board issued a Partial Initial Decision i
i resolving three contentions in LES's favor.
