SUBJECT: NRC INSPECTION REPORT 50-416/96-11 NOTICE OF VIOLATION

We have reviewed your letter dated September 11,1996,in response to our letter and

Notice of Violation (Notice) dated August 12,1996. After reviewing your response, NRC

has determined that a violation of NRC requirements did occur. The Notice described that

the procedures for performing emergency diesel generator tests did not require operators to

monitor the governor oil level after start of the emergency diesel generators, which was

contrary to avai!able guidance. in your response, you indicated that no violation occurred

because your staff had established requirements for verifying the governor oillevel as

required by Regulatory Guide 1.33, Revision 2, Section D.4. Specifically, operators verified

the governor oil level prior to start of the emergency diesel generators. Further, your

response indicated that you relied on the emergency diesel generator wndor for guidance

and did not contact the governor vendor for guidance but would have expected the

emergency diesel generator vendor to do so. Af ter contacting the governor vendor, your

staff determined that governor oil should be routinely verified during operation of the

emergency diesel generator.

As specified in NRC Inspection Report 50-416/96-11,NRC considered the procedures

inappropriate to the circumstances and a violation of 10 CFR Part 50, Appendix B,

Criterion V. Further, contrary to the implications in your violation response, meeting the

intent of Technical Specification 5.4.1.a (Regulatory Guide 1.33, Revision 2, Section D.4)

for establishing a procedure does not eliminate the requirement in 10 CFR Part 50,

Appendix B, Criterion V to have procedures appropriate to the circumstances. The

inadequate procedure resulted because your staff had not taken actions to resolve

conflicting information between the procedure guidance and the information posted on the

governor until questioned by the inspectors. Specifically, although not directly available

from the standby diesel generator vendor, your engineering staff had documentation

available other than the sticker related to maintaining the proper governor oillevel from the

governor vendor. The information from the governor vendor indicated that the oil level

should be maintained at the sight glass scribe mark with the engine operating, whereas

your procedures required ensuring the oil level was at the mark with the engine secured.

Since your operating procedures did not specify the correct conditions for ensuring proper

oil level in the governor, NRC determined that the procedures were not appropriate to the

circumstances.
