Dear Mr. Smith:

l This responds to your letter of July 16, 1985, appealing the initial

)

denial of your document request pursuant to Exemption 7(A) of the i

Freedom of Infonnation Act.

Your letter clarified that you were not seeking the entire 495-page transcript but rather that narrow portion of the transcript which included statements concerning spills or alleged spills and any actions taken with regard to same. The Office of i

Investigations has determined that the requested material, which appears in twenty-nine piges of the transcript, will not interfere with any ongoing investigation.

In addition, these statements also appear in a P.206 petition, Ratner and Schiller v. General Electric Company, which is available in the Public Document Room. The requested material is j

enclosed.
