VOGTLE ELECTRIC GENERATING PLANT REPLY TO A NOTICE OF VIOLATION Pursuant to 10 CFR 2.201, Georgia Power Company submits the enclosed information for Vogtle Electric Generating Plant in response to violations identified in Nuclear Regulatory Commission (NRC) Inspection Reports 50-424;425/96-09, which concerns the inspection conducted by NRC Resident Inspectors from July 7,1996, through August 17,1996.

l ENCLOSURE VOGTLE ELECTRIC GENERATING PLANT-UNITS 1 & 2 REPLY TO A NOTICE OF VIOLATION NRC INSPECTION REPORTS 50-424: 425/96-09 VIOLATION A 50-424: 425/96-09-02 The following is a transcription of the violation "A" as cited in the Notice of Violation (NOV):
"During the NRC inspection conducted on July 7 through August 17,1996, violations of NRC requirements were identified. In accordance with the ' General Statement of Policy and Procedure for NRC Enforcement Actions,' NUREG-1600, a violation is listed below.
A.
Technical Specification 6.7.1.a requires that written procedures be implemented for the activities identified in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Regulatory Guide 1.33, Revision 2, February 1978, requires that procedures defining authorities and responsibilities for safe operation and shutdown be implemented.
Procedure 10000-C, Conduct of Operations, establishes the responsibilities of Operations Department personnel for conduct of plant operations and requires that control room personnel be cognizant of the status of plant equipment.
Contrary to the above, control room operators failed to detect on July 17,1996, that valve 1-HV-27901, Fire Protection Header Containment Isolation valve, was in the incorrect position.
This is a Severity Level IV violation (Supplement I) (Unit 1 only)."
RESPONSE TO VIOLATION A (50-424: 425/96-09-02)
Admission or Denial of the Violation:
This violation occurred as stated in the notice of violation except that the valve was identified to be mispositioned on July 16,1996.
Reason for the Violation:
On July 16,1996, operators discovered fire protection header containment isolation valve 1-HV-27901 open while performing a slave relay test. This fire protection isolation valve is normally closed in all modes and opened only if required to combat a fire inside containment. Subsequent investigations indicated the last time this valve was cycled was during a slave relay test on June 7, 1996. All restoration steps were signed off and independently verified indicating the valve was restored to its normally closed position afler the June 7,1996, slave relay test. Additionally, a review of control room logs, fire protection surveillances and maintenance work activities did not uncover any reasons for this valve to be mispositioned.

1.
Operations Department shift briefings were conducted to discuss this violation and to i
inform operations personnel of the number of configuration control problems experienced in the past 9 months.
Corrective Stens Which Will Be Taken to Avoid Further Violations.
1.
Operations procedure 10000-C, " Conduct of Operations" will be revised to clarify expectations for periodic, methodical observations of control board indications and system alignments. Estimated completion date is October 7,1996.
2.
Control room rounds will be modified to include additional checks of safety-related valves and dampers. Estimated completion date is November 1,1996.
3.
As an interim measure, the partial performance of some system alignments will be conducted to provide assurance that components are in their correct position.
Date When Full Compliance Will Be Achieved:
Full compliance was achieved on July 16,1996, when the valve was returned to the correct 1
position.
VIOLATION B,50-424: 425/96-09-05 The following is a transcription of the violation "B" as cited in the Notice of Violation (NOV):
"During the NRC inspection conducted on July 7 through August 17,1996, violations of NRC requirements were identified. In accordance with the ' General Statement of Policy and Procedure for NRC Enforcement Actions,' NUREG-1600, a violation is listed below.
B.
Technical Specification 6.7.1.a requires that written procedures be implemented for the i
activities identified in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.
Regulatory Guide 1.33, Revision 2, February 1978, specifies that procedures be established to implement the plant fire protection program.
Section 4.1.13 of Procedure 92015-C, Use, Control, and Storage of Flammable / Combustible Materials, states that unused ion exchange resins will not be stored in areas that contain or expose safety-related equipment.

ENCLOSURE VOGTLE ELECTRIC GENERATING PLANT-UNITS 1 & 2 REPLY TO NOTICE OF VIOLATION NRC INSPECTION REPORTS 50-424: 425/96-09 Section 4.2.1.2 ofI rocedure 92015-C, states that transient combustible material that exceeds specified limits are required to have a transient combustible permit.
Contrary to the above:
1.
On July 9,1996, unused ion exchange resins were stored in Rooms 120 and 135, Level 1 of the auxiliary building where safety-related cables and cable trays were approximately 10 feet directly above the stored resins.
2.
Two examples of wooden pallets located inside the auxiliary building identified on August 13 and 14,1996, respectively, that exceeded fire loading requirements did not have transient combustible permits.
This is a Severity Level IV violation (Supplement I)."
RESPONSE TO VIOLATION B (50-424: 425/96-09-05)
Admission or Denial of the Violation:
This violation occurred as stated in the notice of violation.
Reason for the Violation:
The violation was a result of personnel error as described in the following paragraphs:
1.
Personnel failed to comply with procedure 92015-C by issuing transient combustible permits allowing unused ion exchange resins to be stored in areas that contain or expose safety-related equipment.
2.
Personnel using wooden pallets in the alternate radwaste building and auxiliary building failed to obtain the necessary permits required by procedure 92015-C.
Corrective Steps Which IInve Been Taken and the Results Achieved:
1.
Fire protection technicians involved in issuing transient combustible permits were provided clarification on the storage of unused ion exchange resin in areas that contain or expose safety-related equipment. Additionally, it was stressed :o the technicians the importance of transient combustible control and the need to perform inspections to ensure compliance with the procedure.

A notification was sent to department managers informing them of the recent discoveries of transient combustibles without the proper permits and on the importance of complying with procedure 92015-C.
Corrective Steps Which Will Be Taken to Avoid Further Violations:
1.
Procedure 92015-C, "Use, Control, and Storage of Flammable / Combustible Materials" will be revised to provide clear and concise instructions for obtaining permits and on the storage requirements for unused ion exchange resin. Estimated completion date is November 10,1996.
2.
Procedure 92010-C, "Bi Weekly Fire Inspection" will be revised to stress the importance of finding unrecorded transient combustibles and to provide inspection guidance.
Estimated completion date is November 10,1996.
Date When Full Compliance Will Be Achieved:
Full compliance was achieved on July 11,1996, when the resin was moved to an acceptable storage area and on August 14,1996, when the wooden pallets were either removed from the buildings or had the required permits.
