NUREG-0750 Vol. 41 Index 1 INDEXES TO NUCLEAR REGULATORY COMMISSION ISSUANCES January - March 1995 4

l U.S. NUCLEAR REGULATORY COMfAISSION' Prepared by the Division of Freedom of information and Publications Services Office of Administration f

U.S. Nuclear Regulatory Commission

{.

Washington, DC 20555-0001 (301/415-6844) l

Foreword Digests and indexes for issuances of the Commission (CLI), the Atomic Safety :md Licensing Board Panel (LBP), the Administrative Law Judges (ALJ),

the Directors' Decisions (DD), and the Denials of Petitions for Rulemaking (DPRM) are p;csented in this document. "Ihese digests and indexes are intended to serve as a guide to the issuances.

Information elements common to the cases heard and ruled upon are:

Case name (owner (s) of facility)

Ibli text reference (volume and pag' ation) m Issuance number issues raised by appellants Legal citations (cases, regulations, and statutes)

Name of facility, Docket number Subject matter of issues and/or rulings Type of hearing (for construction permit, operating license, etc.)

Type of issuance (memorandum, order, decision, etc.).

These information elements are displayed in one or more of five separate formats arranged as follows:

1. Case Name Index The case name index is an alphabetical arrangement of the case names of the issuances. Each case name is followed by the type of hearing, the type of issuance, docket number, issuance number, and full text reference.
2. Digests and IIeaders The headers and digests are presented in issuance number order as follows:

the Commission (CLI), the Atomic Safety and Licensing Board Panel (LBP),

tie Administrative Law Judge (ALI), the Directors' Decisions (DD), and tie Denials of Petitions for Rulemakmg (DPRM).

The header identifies the issuance by issuance number, case name, facility name, docket number, type of hearing, date of issuance, and type of issuance.

The digest is a brief narrative of an issue followed by the resolution of the issue and any legal references used in resolving the issue. If a given issuance 1

covers more than one issue, then separate digests are used for each issue and i

are designated alphabetically.

3. Legal Citations Index

'i

[

, 'Ihis index is divided into four parts and consists of alphabetical or alpha '

numerical arrangements of Cases, Regulations, Statutes, and Others. *lhese citations am listed as given in the issuances. Changes in regulations and statutes may have 0: curred to cause changes in the number or name and/or applicability -

of the citation. It is therefore important to consider the date of the issuance.

L'Ihe references to cases, regulations, statutes, and others are generally-followed by phrases that show the application of the citation in the particular issuance. These phrases are followed by the issuance number and the full text

- reference.

4. Subject Index Subject words and/or phrases, arranged alphabetically, indicate the issues.

,/

and subjects covered in the issuances..'Ihe subject headings are followed by.

phrases that give speci6c information about the subject, as discussed in the issuances being indexed. 'Ihese phrases are followed by the issuance number and the full text reference.

5. Facility Inder I

. Ihe index consists of an alphabetical arrangement of facility names from the issuance. The name is followed by docket number, type of hearing, dr.te, i

DICESTS ISSUANCf.S OF THE NUCLEAR REGULATORY COMMISSION Comnussion anucipated that, in the vast majonry of snuations, the Presi&ng Officer would run abw oral prewntatwns.

Y Panes have no fundanrtual right to cross-examinanon even in a formal Subpart G procceeng.

The Commission has nade ckar that in a Subpart L procee&ng. the responsitulity for the exanunahon of all witnesses rests with the Plessdang Of6cer, not with the parues.

Z As a general matter, the Comnussma's hcensing boards and premiang offecers have no authonty to direct the Staff in the performance of ns safety reviews.

AA Because the hcensee rather than the Staff bears the burden of proof in a heensing proceedmg.

the mkquacy of Staff's safety review is,in the fmal analysis, not deternunauve of whether the apphcation should be approved. Consequemly it would be pointiens for the presiding officer to rule upon the adequacy of Staff's review.

BB The Comnussmo innelf has the authonty to vacate bcensing acuons or ask for funher Staff review, and has exercised that authonty on appropnate occasmns.

CC The NRC Staff has no obhgatum enher to provide an explananon of its deternunauon to approve a materials hcense anendnrm apphcatum or to make hn&ngs of fact in support of that deternunapon.

DD The NRC Staff is not required to prepare a safety evaluation report pnor to approvir.g a nmierials hcense anendment apphcanon LE' Although the NRC Staff must prepare an environnrntal impact statenant (EIS) addressing any mapw action taken by the Commisuca that may sigmncamly affect the quahty of the human environnrnt (42 (J S.C. 6 4332(2)(C)(19ns); 10 C F R. Part SI). nenher NEPA nor the Comnussion's regulations require the Staff to prepare an EIS if the federal acuon's effect on the environnent is not signiAcant IT

. Although an argument that a regulatory exempuon contravenes NEPA consututes a protubited collattial attack on the regulanon at issue. a party to a Subran L procec&ng nwy file a pcunon for waiver of the bar on collateral attacks against de C mmissiori s regulabons (10 C F R.121239(b)).

1 GG 1hc Comnussma is not a tenera.n safety or occupatmnal health agency. hs responsibihty is arected to the hazards associated with nucicar matenals rather than to all questmns of hre safety at licensed facilases.

JJ Secuans 30 35ta)and 70 25(a)of the Comnussion's regulauons generally require a nwenals hcense appheant to subnut a decomnussmmng fun &ng plan if the anmune of unsealed byproduct maanal or umealed special nuclear matenal to be hcemed exceeds cenam levels. However, secuons 3035(cW2) and 70 25(c)(2) provide spenne excepuons to the requnenents of secuons 30 35(a) and 70.25(a) for any holder of a hcense inued on or before July 27,1940 Such a heensee has a choice of either (l} hhng a decomnuniumng plan on or before July 2f 1990. or (2) 6hng a Ceruhcauon of Financsal Assurance on or before that date and then tihng a decomnussiomny funding plan en its next hcense renewal apphcation.

KK If a matenals hcensee is a governmernal enuty. then sections 3035(fh4) and 70.25(fg4) &ctate the terms of its deconmusammng Cenihcatwn of financial Assurance Both of these secuens state that nnancial assurance for decomnusammng may be provided. "[i}n the case of.

onented activstas. Accor&ngly, the Conurussmn denies the appeal and afhrms the hcensing board's order.

H The Prniding Ofhcer's functmn in a hcense renewn! proceedmg is to decide whether renewal is appropriate and, if so, to detet nune what actiunes can conimue in the renewal term.

C Pursuant to tiu former 10 C.F R 5 40 42(e) (1994), a source malerial bcense may rernaso automancally in effect beyond its expiration date to allow a hcensee to conimue decomemssioning and secunty acuvtues authonzed under the hcense. Seccon 40 42(c) has been superseded by a new automauc heense catension provision.10 C.F R. $ 40 42(c), which became ef fective in August 1994.

D The automanc hcense entennon provision under 10 C.F.R.140.42(c) may extend a keense regrdless of the nature of the source matenal remaming on site.

E The "necessary" provismn (which appears in both the former accuan 4042(e) and the new sectmn 4042(c)) samply neans that the hrruted regulatory heense extension comes into play only when decomnusuomng cannot be completed pnor to the beense's expiranon date.

F The automans heense extension provision grants the hconsee no sweeping powers, but pernuts only hnuted acuvmes related to decomnussionmg and to control of entry to restncied areas. Such actiuties also nut have been approved under the licensee's license. To implement an activity not greviously authonzed by hanse. and thus not previously subject to challenge, the hcensee must first obtain a license arrendment.

G ljeensees need only subnut the 6nal radsological survey showing that the site or area is smiable for release in accordance with NRC regulauons after decomsmssioning has been completed.

H To make a senous case for conditmns. intervenors reasonably can be held to an obhgation to offer some m&tatmn of their objecuve. The proponent of htiganon bears the burden of explaimng which direcuan the hugatmn will take.
