Dear Mrs. Ellis:
The Board's March 15, 1984, Memorandum directed Appaicants to " provide to CASE the evidence on which it relied whent it stated that the preliminary results of its thorough painzt reinspection program, as of February 25, 1983, were favoarable" (Memorandum p. 8).
The reference to February 25, 1983,.is to a proposed finding of fact (194, p.
- 51) that " [t] he initial phases of the reinspection effort confirmed that; ade-quate application of protective coatings had occurred.
The evidence on which Applicants relied is, as cite:d in the proposed findings, the sworn testimony of Ronald G. *Tolson in hearings before the Board.
As relevant to this point;, Mr.
Tolson's testimony appears at transcript pages 2113-21141.
Mr. Tolson also described the backfit program at pages' 2I143-2144.
We enclose Mr. Tolson's affidavit discussing the batsis for the testimony regarding the preliminary results of t'he paint reinspection program.
As Mr. Tolson states in his; affidavit, his July 1982 testimony was based on reports :from Mr. Tolson's staff.
Those reports were, in turn, based con inspection records related to the coatings reinspection program.
