SHOREHAM OPPONENTS COALITION'S REPLY TO SUFFOLK COUNTY OBJECTION TO
_SPECIAL PREHEARING CONFERENCE ORDER Shoreham Opponents Coalition supports Suffolk County's ob-jections (regarding scheduling) to the Board's Special Prehearing Conference Order of August 19, 1983, and urges the Board to reconsider the schedule that is outlined in that Order.
As the County has pointed out, the complex matter of LILCO's ability to perform emergency planning for Shoreham proceeding cannot be litigated in such a short space of time without impinging ser-iously on the minimal procedural rights to which the Intervenors' are entitled.
This would be the case even if the diesel genera-tors were hale and hearty.
The problems that have arisen with the diesels, however, now appear even more likely than emergency planning problems to delay or prevent the licensing of the plant.

- c. We observe that in its August 25 status report on the die-sels LILCO requests that all diesel-related litigation be post-poned at least until a key consultant's report is completed.
The consultant now thinks the report can be completed in "4-6 weeks."
Assuming that this happens and, even more optimistically, that no further problems arise with respect to the diesels, what is envisioned is the submission of new contentions in October fol-lowed by Board rulings on admissibility, Intervenors' objections, further discovery, and the like.
It appears that this process will take many months, and thus that emergency planning litiga-tion will not, as was once thought, delay the licensing of Shore-ham.
This being so, the addition of just a few weeks to the emergency planning litigation schedule would permit a more com-plete review of LILCO's plan without harming LILCO or the "public inte r e s t" at all.
