Specific areas of noncompliance are described in Nonconformance Reports #M01-9-2-125 (Rev-1) and M01-9-2-130 (Rev 2), Attachments 1 and 2 respectively.

In evaluating these noncompliances, the following has been determined:

a) The original design specification requirements for these penetrations referenced SA-105 rather than SA-508 material. b) The specification requirements for these penetrations were subsequently changed to reference SA-508 Class 1 requirements at the request of the forging suppliers.

c) In light of the identified nonconformance, the forging suppliers have determined that the forgings, which do not comply with SA-508 requirements, do comply with SA-105 requirements. As a result, the vendors have proposed reclassifying the forgings as SA-105 material. Revised material certifications in support of the reclassification proposal are provided as Attachment 3.

d) Bechtel has evaluated the supplier's proposed reclassification and concurs.

e) APTECH Engineering Services has conducted an independent evaluation of the supplier /Bechtel proposed reclassification and determined that such reclassification is justifiable. The report documenting the APTECH evaluation is provided as Attachment 4.

In considering the proposed reclassification, Consumers Power recognizes that such reclassification might affect the basis of the Staff's evaluation of compliance with General Design Criterion (GDC) #51. Specifically, the NRC oOl 8306290493 830623 oc0683-0481a100 PDR ADOCK 05000329 t

r evaluation assumed a T value of +10 F for the containment pressure boundary portion of the flued h M penetration.

(The +10aF value is assigned by Table NC-2311 (a)-1 of the Summer 1977 ASME Section III Code for SA-508 Class 1 material.) However, if this material were reclassified as SA-105 material, then Table 4.4 of NUREG CR-3009 would assign a less conservative T value of

- 28 F to the material in question. Thecertifiedmaterialtestrhrtsdo provide sufficient information to demonstrate compliance with the requirements for SA-105 material. However, use of the less conservative (-28 F) T value cannotspecificallybesupportedbythetestresultsactuallyobtaineMor this material. The fracture toughness information necessary to verify this value is not required for certification of SA-105 material and was not obtained.

As a result of the above information, Consumers Power Company intends to take the following actions:

a) The affected penetrations will be reclassified from SA-508 Class 1 mat' rial to SA-105 because the material complies with SA-105 requirements.

Use of SA-105 material in this application is technically acceptable and consistent with original design specification requirements.

b) Subject to final determination of lowest service metal temperature for the affected penetration applications, the more conservative fracture toughness properties of SA-508 Class 1 material will be assumed in evaluating.the containment pressure boundary for compliance with GDC-51.

(Note: The containment pressure boundary is not an ASME Section III Code pressure boundary.

See FSAR Section 3.8.1.6.4 for additional detail.)

This assumption is consistent with the existing NRC evaluation.on compliance with GDC-51 for the penetrations in question in that the NRC evaluation assumed fracture toughness properties for SA-508 Class 1 material. The resulting permissible lowest service metal temperatures for the affected penetrations are shown in Attachment 5.

We believe that the proposed material reclassification is technically justifiable and in conjunction with assuming the more conservative fracture toughness properties proposed will not affect the bases of the Staff's conclusions relative to compliance with GDC-51 as discussed in 6.2.7 of the Midland SER & SSER #2.

If the Staff has any questions regarding these actions relative to their previous SER evaluation, we would request that a meeting be scheduled at your earliest convenience to resolve such concerns.

specification 7220-M-111 Tech Spec M-210 Para 5.1 requires the manufacturer to certify ma.erials in accordance with ASME Sec ion III Para NB-2130. ASME Section III Para NB-2130 states in part; "All ma erials used in construction of componen s shall be certi-fied as required in NA-3767.4 and NA-3767.5." ASME Section III Para NA-3767.4 requires the manufacturer to provide a CMTR and further requires the mar.ufacturer to "cer ify that...all operations performed by him or his subcontrac or are in compliance with the requirements of he material specification and this Section." ASME Material Specification SA-508 states in part:

Para 6.1.2 "Two tension test specimens shall be taken from each forging., The second specimen shall be aken at a location 180*

from the first."

Para 6.1.3 " Samples for mechanical test specimens shall be removed from forgings after the quenching and tempering heat treament. "

Part 2 Partial review of vendor-sulatitted (PO 7220-M-ll1Q) CMTRs and heat treatment charts for flued head fittings indicates that no tension ests or incomplete tests were performed after quenching and tempering of the forgings. EXAMPLE: In AEO Package #4278 (Penetra-tion #1Z-12), Tube nirns Corps analysis report of physical tes s results may have been copies from a sub-vendors (Gulf Coast Machine & Supply) report da.ed 1/5/77. The associated heat treat-ment chart indicates that the forging was heat trea ed on 2/22/77.

No evidence is available to verify that the forging was subjec ad to tension testing after heat treament.

NONCONFORMANCE:

Contrary to Block 16 (Requirement), Ultrasonic Test Reports for Flued Head Pittings (PO M-111, manufactured and inspected by Colt Industries) indicated that R Gelly had performed the ultrasonic examinations as a Level I.

Sub-sequently, a trip was made to Colt Industries. No evidence could be provided that R Gelly held any level of certification prior to his Level II certifi-cation of 5/12/77. Attached is a list of flued head fittings that were ultrasonically examined by R Gelly prior to his Level II certification.

Ultrasonic test reports for the attached list of flued head fittings are considered invalid, rendering the acceptability of the fittings indeterminate.
