In order to keep the Board apprised of matters related to the captioned proceeding I wish. to. advise the Board of the following.
On December 16, 1982 the Commonwealth Court sitting en bane reversed the decision of the Public UtilitiU Connission Order dated August 27, 1982 concerning the financing of Limerick Unit 2.
An opinion will be issued later.
This Board has been advised that Del-Aware Unlimited, Inc. et al.
(" Del-Aware") moved the United States District Court for the Eastern District of Pennsylvania on November 17, 1982 for a preliminary injunction to enjoin work on the Point Pleasant Diversion Project predicated upon various grounds including those pending before this Board.
By an order delivered from the bench on December 15, 1982, the Honorable James T.
Giles, Jr. Judge of the United States District Court for the Eastern District of Pennsylvania, denied the motion of Del-Aware for a preliminary injunction 8212230327 821217 PDR ADOCK 05000352 O
