This is in response to your letter dated November 23, 1981, which requested relief from 10 CFR 70.58(i)(2) as it has been applied to combustible waste at your facility.
We have determined that granting the requested relief will not endanger the public health and safety nor the coninon defense and security and that it is othemise in the public interest to do so. Therefore, effective inanediately, we are replacing present License Condition 7.1 of Amendment No. MPP-3 to your License No. SNM-1097 with the following:
7.1 Notwithstanding the definition of scrap contained in 10 CFR 70.4(u),
SNM-containing trash and oil retained for further processing via incineration may be classified as disposable waste with no associated time limit for retention. Ash residues generated by incineration shall either be classified as scrap and treated as required by 10 CFR 70.58(1)(2) or classified as waste and buried if further processing is not appropriate.
It has been established that the attacinent to your letter dated November 23, 1981, contain information of a type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be consnercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
