ypusv The Aamodts have served on Licensee's counsel a Notice of Taking of Depositions of Individuals Associated with Licensee, Document Request, and Request for Identifying Information, dated October 20, 1981.

The Request for IdenLii,'ing Information includes a request that Licensee supply the name and last-known 1

address and telephone number of each of three individuals (X, SS and NN) who as candidates for operator licenses took the NRC examination last April and who have since resigned their employ-ment with Licensee.

Licensee objects to this request and has so informed counsel for the Aamodts by telephone on the morning of October 22, 1981.

Compliance with the Aamodts' request would mean identify-ing by name individuals who may later be accused of involvement in cheating or other improprieties with respect to examinations, 503 9

Further, contact by the Aamodts with these individuals could, if it served any purpose at all, result in disclosure by those individuals of the names of others alleged to be involved in cheating or rumors of cheating, since the individuals who have resigned do not have kncwledge of the letter designations of other Licensee personnel.

In his Memorandum and Order Following a Conference Among the Parties, dated October 8, 1981, the Special Master directed that pending a ruling, the parties were instructed to designate examinees by using Licensee's lettering system.

No such ruling having been made by the Special Master and none having been re-quested by the Aamodts, the Aamodts' request for the names of individual examinees is out of order.

Licensee further notes that none of the three individuals who have resigned has been featured or, to the best of counsel for Licensee's recollection, even mentioned in any of the investiga-tions of possible cheating or rumors of cheating in either NRC or Company administered examinations.
