AMENDMENT TO INTERVEt10RS' EVIDENTIARY FIllHG

.[

~.

1-The following' constitutes an Amendment to Estelle Lit's and I

Prof essor Jerome E.

Raskin's Full Evidentiary Statement filed on

.I Pebruary 13, 1990.

This pleading wi11 serve as the legal suppott t-i L

and a request for. relief to our expressed concerns regarding

.l '

health and safety.

I Within.the February 13, 1990 Full Evidentiary Statement we i

expressed concern by stating the following:

(1)

Rocketdyne will l

jeopardize the health and saf ety of the surrounding communities if l.

-i.

they continue to use radioactive materia 3s; (2)

Rocketdyne uses j

outdated t esting procedures t o monitor possible contamination;'

l (3)

Rocketdyne uses misleading data supporting their conclusion-that the population'is not at rink; (4)

The ext,ent of i

radioactive contamination already documented, justifies non-j i

renewal of Rocketdyne's license; and (5)

Reports lowering the

. threshold exposure to carginogenous materials war rant non-renewal fI p

LRaskin, 2-13-90)

NRC regulations address these five, concerns.

l f:

1

s.

,. pursuant to 10 CPR 70. 23(a )( 3 ) and (4), an application can be "7

approved if the Commission determines, among other things, that the ' applicant's proposed equipment, procedures and faci'.ities are i

" adequate to protect health and minimize danger to life or l

"~

i B

. property."

The NRC regulations further provide that:

i.

.a, l

1(

l No license will be i.ssued by the Commission to any i

-person within the United States if the Commisssion finds U

3 that the issuance of such license would be inimical to i

y p

~;;

the common defense and security or would constitute an unreasonable risk to the health and safety of'the j

(d: b public.

10 CPR 7 0.31(d).

.j-i l

The regulations also require Rocketdyne to "make every reasonable j

1 i

effort to maintain radiation exposures, and releases of radioactive materials in ef fluent s to unrestricted areas."

10 CPR s

1 20.1(c).

f.,

<Rocketdyne has violated these safeguards mandated by t he i

t.

l,,y l

' regulations..

As stated-in our third and fourth concerns,;

Rocketdyne's past failures to control radioactive contamination l'

r coupled with their problematic monitoring procedures indicate.

that Rocketdyne will not change its behavior, Additionally,10 CFR 70.9 requi res tha t Rocketdyne provide-1

,e complete and accurate.information to the Commission.

As stated 5

1 in our original complaint, Rocketdyne has not, supplied the

]

Commission with complete and accurate information.

l$

Therefore, intervenors, Estelle Lit and Jerome Raskin!

l lt

.l,

! g.

request ~ that Rocketdyne's renewal application be denied.

This in the l

t V'

' %p;7 only relief that can ensure safety in our community, especially

('

Y i

given'Rocketdyne's gross safety violations,.
