JAN 3 01990 Ms. Linda L. Bauman IN RESPONSE REFER FOIA Coordinator TO F01A-89-A-34 Robinson, Robinson, Peterson, Berk, Rudolph, Cross &' Garde (F01A-89-445) 103 East College Avenue Appleton, WI 54911

Dear Ms. Bauman:

This is in response to your letter dated December 5,1989, in which you appealed Mr. Donnie H. Grimsley's response dated November 22, 1989.-

Mr. Grimsley's response denied portions of six records subject to your Freedom of Information Act (F01A) request for copies of all records related to every' chronology of events prepared by on-site Office of Special Projects staff-beginning in'1985 for the Comanche Peak plant.

You specifically appealed the denial of portions of the six records identified on the enclosed Appendix B of-Mr. Grimsley's response dated November 22, 1989.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that'some additional information can now be made publicly available. Your appeal is, therefore, partially granted and partially denied.

The previously deleted information in the documents identified at numbers three, four and five on the enclosed appendix can now be made publicly available. The three documents are enclosed in their entirety.

In addition, certain previously withheld information in the document identified at number six on the enclosed appendix can now be made publicly available and-is enclosed.

The remaining withheld portions of the _three updated chronologies identified at. numbers one, two, and six on the enclosed appendix consist of-four separate entries containing names the disclosure of which would cause a clearly unwarranted invasion of personal privacy. These names will-continue to be withheld from public disclosure pursuant to Exemption-(6) of.the FOIA (5 U.S.C. 552(b)(6) and 10 CFR 9.17(a)(6) of the Commission's regulations.

I am unable to identify any legitimate public interest in the release of this-information which outweighs the privacy interests-of the-individuals.
