WEEK ENDING DECEMBER 22, 1989 Shoreham On December 15, 1989, the Long Island Lighting Company (LILCO) submitted a request for license amendment to eliminate the need for its Local Emergency ResponseOrganization(LER0). LILCO's request for license amendment involves removal of License Condition 2.C(13), which requires quarterly traininI drills of LER0', and an exemption from the requirements of $50.47. 9th Circuit. Court. Appeals On December 20, 1989, the U.S. Court of Appeals for the 9th Circuit reversed in part a District Court decision (Mathis v. employees claimed that the screening and dismissals had been forced upon PG&E by the NRC, that PG&E had failed to offer the ex-employees any appeals of the dismissals, and that because the screening had been forced upon the company by the Federal government, the licensee was required to offer the same constitutional protections, e.g., right to appeal, that would have been required had the government itself done the screening.
The appeals court held that the lower court had aroperly dismissed the action against the NRC, but that the employees siould be allowed to try to show that PG&E was responding to government coercion in implementing its screening process.

Office of Nuclear Reactor Regulation Items of Interest Week Ending December 22, 1989 peach Bottom.. Units 2.and 3 As of 6:00 am on December 20,1989, Unit 3 was at 74 pet cent power in its restart power testing program. The unit achieved initial criticality (since-being shutdown in 1987) on November 20, 1989. During restart, the licensee addressed problems in various systems, including the EHC pressure control system, RCIC and HPCI systems, and emergency service water flow to various ECCS components. The unit was again placed in the startup condition on December 5 and has completed HPCI/RCIC testing, turbine overspeed testing, and portions of recirculation and feedwater flow control testing. The licensee plans to continue power ascension to full power later this week.
Unit 2 is currently operating at 100 percent power.
Sequo.yah. Units 1.and.2 L
On December 16,1989, at 6:15 a.m., TVA was granted discretionary enforcement for Sequoyah, Units 1 and 2.
The units were in LC0 3.0.3 based on inoper-j ubility of wide range level transmitters on the refueling water storage tank.

unusually cold weather. The narrow range level transmitters were operable.
Adequate compensatory measures were taken by TVA during the period of enforcement discretion. The LCO was exited for Unit 2 at-10:56 a.m. and for Unit 1 at 6:45 p.m. on December 17, 1989.

South Texas Project. Unit.1.(STP-1)
At 2155 on December 16, 1989, the licensee declared an unusual event upon initiating a plant shutdown required by the Technical Specifications. The shutdown was begun because components (essential chillers) in two of three safety trains were declared inoperable.

At 0242 on December 16,1989, the No.11 emergency diesel generator (which serves train "A") was declared inoperable when the generator voltage regulator failed. The Technical Specifications require that the components on the remaining two trains be verified as operable. At 2155, the essential chiller in the "C" train could not be tripped and was declared inoperable. At that point, the plant had two hours to return one of the chillers to operable status, or begin to shutdown the plant (hot standby in six hours and cold shutdown in 30 hours3.472222e-4 days <br />0.00833 hours <br />4.960317e-5 weeks <br />1.1415e-5 months <br />). The chiller remained inoperable and the plant was in hot standby (Mode 3) by 0555 on December 17, 1989.
During the shutdown, with the plant at 1% power, a feedwater isolation occurred due to a high-high level in the "A" steam generator. The licensee was controlling level with the feedwater bypass valves and isolating the main feedwater regulatory valves. The water level reached 88% (setpoint is 87%) and an isolation signal was received. Heat removal'was continued via the auxiliary feedwater system.
The plant remains in Mode 3.
The licensee repaired the "C" chiller, declared it operable, and exited the UE at 1950 on December 17, 1989. The No. 11 diesel generator voltage regulator was repaired but as of 0900 on December 18, 1989, the diesel was not declared operable. The LCO expires at 0242 L
on December 19, 1989.
l During the shutdown, STP-1 experienced other problems, unrelated to the diesel l
and chiller:
the atmospheric dump valve from the "D" steam generator would not open; and a discharge isolation valve on the circulating water system failed closed, causing a water hammer and subsequent crack in the casing in one of four circulating water pumps. The licensee also discovered a ruptured bellows L
on the No. 13-low pressure stage of the main turbine, which allows steam to I
bypass the last two low pressure stages.
The-circulating water pump and main generator problems will not prohibit plant operation. The licensee expects to complete repairs and investigation of the other failures, and restart by December 21, 1989. Region IV and the resident inspectors are monitoring the licensee's actions.
Three Mile.Is1and Unit.2 On Saturday, December 16, 1989, GeneralPublicUttlitiesNuclear(GPUN) l Corporation completed bulk defueling of the TMI-2 reactor vessel. Bulk defueling was declared complete when the reactor vessel lower head was I
cleared of debris. A total of approximately 300,000 lbs. of core debris and intermixed materials were removed. Several hundred pounds of finely divided fuel debris remain, principally as a dust layer on horizontal surfaces.
GPUN defueling crews will remove this remaining fuel by vacuuming brushing and water flushing. These activities should be completed by early January 1990. After two weeks of video verification of defueling completion the reactor vessel will be turned over to an international research group for reactor vessel lower head sampling. The one month long research effort will obtain metallurgical samples from instrument penetrations and the reactor vessel lower head.

Mr. Cartwright will fill the position of Vice-President Fossil and Hydro Operations on January 1, 1990, a position he previously held.

1 SAFEGUARDS Transportation Package. Supplier. Inspection On December 12-15, 1989, a quality assurance inspection was conducted at Equipos Nucleares, S.A. in Maliano, Spain, by two members of the Transportation Branch, supported by a radiography specialist (Level III) from Idaho National Engineering Laboratory. The inspection focused on quality assurance in the fabrication of five legal weight truck spent fuel casks for Nuclear Assurance Corporation. Two casks have been completed and three others are in various stages of completion. The inspection team identified seven indications (lack offusion)inradiographsforfouroftheunits. Nuclear Assurance Corporation '
disputes characterization of indications as lack of fusion. A review panel is being established to resolve the dispute. A quality assurance inspection was also conducted at Nuclear Assurance Corporation, Norcross, GA, on November l
13-16, 1989, by three members of the Transportation Branch. This inspection L
focused on activities concerning internal audits, cask maintenance, calibration of test equipment and document control.
L HIGH-LEVEL WASTE.hANAGEMENT NRC-DOE Technical.E< change on. Draft. Seismic Hazards Technical. position On December 19-20, 1989, NRC and DOE engaged in a technical exchange on the NRC draft Technict.1 Position on Methods of Evaluating the Seismic Hazard at a Geologic Repository and on related topics. DOE presented for discussion its ideas on developing a seismic design basis for the repository, including the concept of the 10,000 year cumulative slip earthquake. The State of Nevada also participated in the exchange, with two members of the Nevada Bureau of Mines giving-presentations on historical earthquakes in Nevada and their significance relative to calculation of 10,000 year cumulative slip earthquakes.
LOW-LEVEL WASTE MANAGEMENT Receipt.of. Governor!s Certifications from. Kansas and. Texas NRC received the first three of the expected 33 Governor's certifications for the 1990 milestone of the Low-Level Radioactive Waste Policy Amendments Act of1985(LLRWPAA). Under the LLRWPAA, states without currently operating LLW disposal sites within their borders or disposal compact regions are to submit by January 1, 1990, either a complete license application for a new disposal facility or a certification that the state can and will provide for the storage, management, or disposal of any LLW generated within the state and requiring disposal after 1992. The Act requires NRC to transmit any certification re-ceived to Congress and publish it in the Federal Register. Staff has initiated processing of the Kansas, Texas and West Virginia certifications.

I Office of Nucleer Regulatory Research Items of Interest Week Ending December 22, 1989 Resolvinc. Safety. Issues.and. Developing. Regulations Publication.by the National. Academy.of Sciences of a report. entitled
" Health-Ef fects. of. Exposure to. Low Levels.of. lonizing. Radiation'!.BEIR.V The NRC staff has received copies of BEIR V report. This report was generated at the request of the Comittee on Interagency Radiation Research and Policy Coordination (CIRRPC) of the Executive Office of the President, and represents an updating of the information presented in the BEIR III report of 1980. CIRRPC's Science Panel has already established a Science Subpanel to examine the potential Nations Scientific Comittee on the Effects of Atomic Rediation (y the United implications of the BEIR V report and a similar report prepared b UNSCEAR)which was published in 1988. This subpanel will review the two reports, sumarize the findings, and examine how the reports and their findings might be applied to present and future Federal activities. The NRC staff has a representative on this subpanel, and also has representatives on the CIRRPC Science Panel and the CIRRPC Policy Panel.
l In addition to the NRC staff actions related to the CIRRPC analysis of the BEIR V report, the NRC staff will be examining the report and determining if, and how the risk estimates currently being used by the staff should be modified.
The preliminary analysis indicates that the BEIR V report risk estimates, although higher than those in BEIR III report, are similar to those of the 1988 UNSCEAR report. The increase in risk estimates appears to apply only to the cancer _ inducing effects of radiation, whereas the estimates of genetic effects remain essentially unchanged. A number of NRC staff actions, such as the Commission Policy Statement on Exemptions frem Regulatory Control, have already incorporated an increased risk coefficient based upon the UNSCEAR report of 1988 and other information which has been available on the dosimetry and epidemiology of the Japanese atomic bomb survivors. The same is true for risk assessments.
In anticipation that the BEIR V report could result in some modifications for the health effects and risk coefficients used in NUREG/CR-4214,
" Health Effects Models for Nuclear Power Plant Accident Consequence Analysis" the NRC staff has initiated a project to develop any modifications that might be necessary for the risk models currently in use. After the staff has had the opportunity to examine the BEIR V report in detail, it may make recommendations

to the E00 and the Commission, as appropriate, if changes in rulemakings, regulatory guidance, or other actions are warranted.

l On December 21, 1989, at the invitation of the Presidential Commission, Dr. Shlomo S. Yaniv, RPHEB/DRA made a presentation on " Assessment of Detriment from Radiation Exposure-Stochastic Effects." Dr. Yaniv appeared before the Commission as individual scientific expert.

-I Week Ending December 22, 1989 Division.of. Safety Programs An AEOD staff member gave a presentation on the Performance Indicator (PI)
Program at the Region IV resident inspectors meeting on December 14, 1989.
The purpose of the presentation was to describe the purpose of the NRC PI program, the definitions of each indicator, and examples of information available in the PI report. The-role of the Regions in reviewing the draft report was discussed.
It was explained that an extensive review is not necessary, but that a comparison of the data with the residents understanding of plant performance is sufficient. The presentation concluded with a discussion of the recently issued Announcement No. 200 concerning the use of performance. indicators.
Division of Operational Assessment IRB staff members attended the Federal Response Subcommittee meeting of the Federal Radiological Preparedness Coordinating Committee on December 19, 1989.
The issues that were discussed included a report by the Special Subcommittee of Revision of the FRERP. The Subcommittee was composed of representatives from many Federal agencies, and during the week of December 4-8, arrived at an agreement for revising the 1985 version of the FRERP. The Subcommittee also discussed an update on planning for the Post Emergency Tabletop exercise scheduled for September 18, 1990.

IRM Annual Briefing to. Program.0ffices IRM presented their second annual briefing to offices on IRM budget, plans, and technical strategies for the operating year on December 18.
Subjects. presented included office automation, directions in telecommun-ications, electronic document transmittal and retrieval, and service levels. Hendouts were sent to offices not in attendance.

CintichemcInc.
On December 12, 1989, Cintichem, Inc reported the discovery, on November 28,1989, of slightly contaminated water in an onsite storm drain. An investigation initiated by the licensee indicated that the source of the i
contamination was a broken, underground concrete exhaust duct which connected the hot cells with the filtration system and plant stack. There is no evidence of offsite environmental releases. Analyses of recent water samples from the storm drain indicated that the level of contamina-tion has decreased significantly. A Region I inspector is on site to review the licensee's actions and analytical results and to obtain confirmatory samples for analysis in the Region I laboratories.

Millstone Commissioner Remick gave a keynote speech on December 15, at the Millstone Station onsite training facility. The speech, which was requested by Northeast Utilities / Northeast Nuclear Energy Company management, was presented to training instructors at the end of a week-long NU/NNECo training seminar.

Pilgrim l
The plant was restarted on Tuesday, December 12 following the scram of l
Friday, December 8, and has been returned to 95% power. The startup went j
smoothly.
The licensee submitted their final assessment report of the power ascension program on December 15. The NRC Pilgrim Restart Assessment Panel will review the report and plans to meet with the licensee to discuss the report and overall performance in early January.
4.
Nine Mile. Point Unit.1 On December 20, 1989, Niagara Mohawk informed Region I that fuel loading of Nine Mile Point Unit I was expected to begin on December 21.
Region I has completed an independent review of Niagara Mohawk's readiness for reload activities with satisfactory results and plans to provide augmented coverage of reloading activities. Unit I continues to be under CAL 88-17 of July 1988, which restricts restart of Unit I until Regional Administrator approval is granted.
5.
Pilgrim Requalification NRC administered requalification examinations were ccnducted the weeks of December 4 and December 11, 1989, at the Pilgrim Nuclear Power Station.

Enforcement Conference On December 18, selected staff members conducted an Enforcement Conference at Hospital San Pablo in Puerto Rico, regarding corrective actions for apparent violations identified during an inspection on November 17, 1989.
2.
Florida Power. Light Company On December 22, representatives of the Florida Power and Light Company were in the Region 11 Office to discuss Operator Training deficiencies at their St. Lucie Nuclear Power Station. Specifically, during recent operator examinations it was identified that operators had not been adequately trained to handle multiple accident scenarios.
3.
Duke. Power Company The new Plant Manager for the Ocenee Nuclear Power Station (effective January 1,1990) met with the Regional Administrator and selected Region 11 staff on December 21, 1989.
4.
System Energy Resourceseincorporated The licensee is conducting a safety system functional inspection of the electrical systems at Grand Gulf. During the review, the licensee iden-tified and reported on December 15, 1989, seventy-two non-Class 1E com-l ponents that were electrically tied to a Class IE power supply in vio-lation of Reg Guide 1.75 isolation requirements. An additional six more components were identified on December 20, 1989. These components consist of temperature and pressure switches, hand switches, and fuses. The licensee is performing failure analysis and replacement of components as appropriate. A JC0 has been prepared and is under review by Region 11 and Headquarters.

Carolina. Power-and Light Company... Harris Following completion of the second refueling outage, the plant was taken critical at 0940 December 20, 1989, and expects to tie to the grid today.
The licensee entered the outage October 9, approximately two weeks earlier than planned as a result of damage caused by a fire in the turbine area.
Major outage work included refueling, containment integrated leak rate testing, steam generator eddy current testing, emergency diesel generator maintenance, and fire damage repair.

Virginia Electric and. Power Company North Anna Unit 1 achieved criticality on December 20, 1989 at 2255 hours0.0261 days <br />0.626 hours <br />0.00373 weeks <br />8.580275e-4 months <br /> after a forced outage due to an EHC problem which initiated a reactor trip on December 5.
During an attempted startup of the unit on December 12, DECEMBER 22, 1989 ENCLOSURE N
2-the "B" reactor coolant purp sustained an electrical ground and subsequent motor trip. The licensee has replaced and tested the motor successfully, Currently. Unit 1 is on-line at 30 percent power in a hold for a chemis-i try check and is expected to achieve 100 percent power on December 22.
Unit 2 is currently at 100 percent power.

Carolina Power.and. Light Company.. Robinson Reactor was made critical at 2:12 a.m. December 22, following a maintenance shutdown that began on Au 22, 1989, to correct NPSH problems for the auxiliary feedwater (AFW) gust system. The AFW suction pipe was replaced, pumps were overhauled and testing and analysis performed to assure opera-bility. Also during the outage, actions were taken to correct Patel seal EQ problems, to correct restricted SW flow to containment coolers and to correct potential degraded voltage conditions resulting from increased motor acceleration time and tolerances of agastat relays which sequence on ECCS loads. Agastat relays were replaced with solid state relays. The turbine driven auxiliary feedwater pump flow control valve is being adjusted at low power. An integrated AFW test is planned at 90 percent

Fermi Wuclear Power. Station Mr. J. Lobbia, Presicent, and Mr. B. Ralph Sylvia, Senior Vice President, Nuclear, Detroit Edison Company, met with the Regional Administrator on December 20, 1989 to discuss the status and performance of the Fermi Nuclear Power Station.

NRC Regulatory impact. Survey Dr. Thomas E. Murley, Director, Nuclear Reactor Regulation, met with the Regional Administrator in the regional office on December 18, 1989 to discuss the results of the NRC Regulatory Impact Survey and the preparation of the report.
3.
Memorial. Hospital. -South. Bend. Indiana C. E. Norelius, Director, Division of Radiation Safety and Safeguards, and selected members of the Region 111 staff conducted a telephone enforcement conference on December 22, 1989, to discuss the findings of a recent special inspection, enforcement options and the licensee's corrective actions. The main topics discussed were the licensee's failure to maintain surveillance of brachytherapy sources in unrestricted areas and prompt.

Speaking Engagement at Denver. Senior Wich School The Director Uranium Recovery Field Office, addressed the chemistry clessesofHIghlandsRanchSeniorHighSchoolinDenveronDecember18, 1989. Subjects addressed included the uranium fuel cycle, nuclear power generation, and waste disposal issues.

Wolf Creek Generating Station forrest Rhodes, Vice President, Engineering and Technical Services and members of the Wolf Creek Nuclear Operating Corporation staff met on 1
December 20, 1989, with members of the Region IV staff at the licensee's request to discuss general operating matters.

Fort Calhoun and. Cooper Stations Icing conditions on the Missouri River have continued to draw interest from the news media.
Ice jams can result in rapid changes in river levels and reduced river flow. Both Fort Calhoun and Cooper stations have experienced icing conditions on the river. Both utilities have established contingency plans in the event of reduced river flow. River levels at both plants remain at acceptable levels. There is close communications between the utilities and the Arnty Corps of Engineers.

This will be effective January 1, 1990, while E01 awaits SEC and PSC approval of the operating agreement.

Diablo Canyon. Nuclear Power Plant The Deputy Regional Administrator and appropriate staff held an i
enforcement conference with the President of Pacific Gas and Electric Company and members of his staff to discuss two potential enforcement concerns on December 19, 1989. The first concern was related to debris in the containment recirculation sump and gaps in the screens to this sump.
The second concern dealt with the assignment of an unlicensed individual to the Shift Supervisor position.

Washington Nuclear Plant.. 2 A Notice of Violation and Proposed Imposition of Civil Penalty in the sum of $50,000 was sent to the licensee on December 21, 1989. The notice set forth violations of NRC requirements involving a number of failures on the part of the licensee to adequately assure the quality of commercially procured items installed or available to be installed in safety-related systems of the facility.

9th Circuit. Court Appeals On December 20, 1989, the U.S. Court of Appeals for the 9th Circuit reversed in part a District Court decision (Mathis v. NRC) that had dismissed a 1986 lawsuit filed against the NRC (for failure to exhaust administrative remedies) and Pacific Gas & Electric Co. by former Diablo Canyon contractor employees whose employment had been terminated because they had failed licensee mondated drug or background screening.
The employees claimed that the screening and dismissals had been forced upon PG&E by the NRC, that PG&E had failed to offer the ex-employees any appeals of the dismissals, and that because the screening had been forced upon the company by the Federal government, the licensee was required to offer the same constitutional protections, e.g., right to appeal, that would have been required had the government itself done the screening.
The appeals court held that the lower court had properly dismissed the action against the NRC, but that the employees should be allowed to try to show that PG&E was responding to government coercion in implementing its screening process.

ISSUE 5 ON EVOLUTIONARY LIGHT WATER REACTORS - SECY to J. Taylor, EDO and C. Michelson. Acting Chairman. ACR5 dated 12/15/89 In SECY-89-311, the staff requested guidance on whether:
- a. New generations of reactor designs should be demonstrably safer than the current generation, and
- b. The staff's approach to the review of evolutionary LWRs is appropriate.
The Commission, with all Commissioners agreeing, reaffirms its expectation stated in the Policy Statement on Severe Reactor Accidents Regarding Future Designs and Existing Plants, that vendors engaged in designing new standard (or custom) plants will achieve a higher standard of severe accident safety l
performance than their prior designs."
In order to accomplish l
this goal, in promulgating 10 CFR 52, the Commission incor-porated the criteria and procedural requirements from the Severe Accident Policy Statement.
Generally, the Commission has indicated that it believes a new design for a nuclear power plant can be shown to be acceptable for severe accident concerns if it addresses the TMI requirements, unresolved safety issues, the medium and high priority generic safety issues, and the severe accident vulnerabilities exposed by a completed probabilistic risk assessment.
In staff's application of these criteria during reviews, it is expected that significant policy questions may arise.
The staff should elevate to the Commission, as early as possible, all issues dealing with policy considerations as follows:
1.
Instances where staff proposes to require measures that depart from current regulatory requirements -- including, but not limited to, design enhancements to address severe accident vulnerabilities -- should be addressed in the licensing review basis (LRB) document prepared for a proposed design.
Staff should provide comments and recommendations to the ACRS and the Commission on all future applicant proposed LRB documents, so that the Commission can provide policy guidance to the staff before i
j the staff position on a final LRB document is established.
Licensing Review Basis documents should be reviewed by the l
ACRS and sent to the Commission for approval.
Vendor or EPHI goals that go beyond our regulations should not be imposed as requirements for individual designs, but the LRBs and SERs for specific designs should include a discussion of how the design compares with the EPRI design requirements document.

The ACRS should review both the GE ABWR and the CE System 80+ LRB documents and comment on each.
The ACRS should pay particular attention to the issue of whether the i
approach taken in the two LRB documents is consistent.
2.
Staff should also advise the commission of additional potential policy issues when they arise during the review of the advanced plants.
Prior to documentation in the draft safety Evaluation Reports, staff should provide the commission an analysis and rationale for any proposed policy and cite how it would be applied in the SER.
If ACRS review has not been provided prior to submitting the policy issue paper to the commission, the ACRS should provide its comments to the commission as soon as e
possible, in order to minimize potential delays in issuing the SERs.
With adherence to the above requirements, it should not be necessary for the commission to become involved in the review and approval of all draft / final Safety Evaluation Reports for the standard plant designs before they are issued.
- However, the commission, for its information, would like to receive a copy of those SERs well in advance of issuance, with all significant policy issues highlighted and discussed in the submittal from the staff to the commission.
The Commission will provide additional guidance regarding generic rulemaking following receipt of staff's paper on Proposed Departure from Current Regulations.
B.
STAFF REQUIREMENTS - SECY-89-334 RECOMMENDED PRIORITIES FOR REVIEW OF l

This is to advise you that the commission, with all commissioners agreeing, has approved your proposed priority of reviews of evolutionary, passive and advanced reactor design submittals subject to the following:
1.
Should a domestic interest in one of the plant design submittals be demonstrated, staff should reconsider the priorities and advance the selected design to the highest priority.
In that eventuality, staff should propose a revised, updated priority ranking for commission review and approval.
I 2.
Staff should use December 1991 as the target date for completing the CE System 80+ FDA, unless unforeseen difficulties arise in issuing the LRB document.
The commission should be advised of any significant change in the target date.

Until there is a demonstrated domestic interest expressed for either the GE ABWR or CE System 80+ power stations, staff should assign equal priority in the review of the

ABWR, System 80+ and the EPRI Requirements Document for Evolutionary Plant Designs, with a particular focus on resolving those evolutionary plant issues which will carry over into the passive plant requirements document. In order to provide added NRC status to the EPRI requirements document, when reviewing specific designs, the staff should consider the EPRI requirements document and dedicate a section in each SER which highlights those areas where the. resolution of evolutionary plant issues is different than the resolution achieved through the review of the EPRI requirement.
Staff should submit to the Commission a projection of the resources necessary to adhere to the proposed schedules, assuming timely submission of the necessary information by the vendors and EPRI.
4.
Staff should ensure that the SER on Part III of the EPRI Requirements Document is completed prior to submitting to the ACRS the proposed licensing review bases for passive plants.
In the event that insufficient resources are available to review both Part III of the EPRI Requirements Document and the proposed passive designs, resources should be allocated first to the EPRI Requirements Document.
The SERs on the EPRI Requirements Document for both the evolutionary and the passive plant designs should be submitted to the ACRS for review and comment and to the Commission for information and for review and approval of policy issues for which the Commission has not previously decided.
5.
Staff should confirm with the Department of Energy that the proposed schedules for the H AP-600 and GE SBWR designs are consistent with the program that DOE has in mind for these designs.
Staff should advise the Commission if the schedule proposed by the staff is incompatible with DOE's schedule.
6.
The staff's proposed review schedule of the H SP/90 design (issue a preliminary design approval by June 1990) is acceptable.
7.
With respect to the CANDU and PIUS designs, consistent with the LMR and HTGR reviews, staff should evaluate the need for a prototype demonstration facility (either in this or another country).
8.
In regard to Staff Requirements Memorandum dated July 31, 1989 (M890620), staff should submit responses to (tems.
col. and c.2. by December 29, 1989.

- as noted below approved revisions to its policy statement on maintenance at nuclear power plants to emphasize l
the Commission's expectations and future plans in the maintenance l
area and to restate the Commission's views with respect to what constitutes an effective maintenance program.
The Commission
- also approved revisions to the policy,and procedures for enforcement actions to add a civil penalty adjustment factor for violations involving maintenance deficiencies at nuclear power plants.
Revisions to the enforcement policy will only be applied for violations which l
occur 90 days or later after the date of publication in the Federal Register.

All Commissioners have approved the policy statement as attached on maintenance at nuclear power plants.

- Section 201 of the Energy Reorganization Act, 42 USC $5841, provides that action of the Commission shall be determined by a
" majority vote of the members present."
Commissioner Roberts was not present when this item was affirmed.
Accordingly the formal vote of the Commission was 4-0 in favor of the decision on the revised policy statement on maintenance of nuclear power plants and 3-1 in favor of the decision on the policy and procedures for enforcement actions.
Commissioner Roberts, however, had previously indicated that he would approve this paper and had he been present he would have affirmed his prior vote.

Commissioner Remick disapproved the enforcement portion of the maintenance policy due to reservations regarding the ability to conclusively determine that maintenance is a root cause of a regulatory violation.
He also believes that the special treatment of maintenance violations in this way could draw licensee's attention and resources from other operational areas

which might have equal or even greater safety importance 1
relative to maintenance.
1 The staff is requested to inform the commission on the public comments received related to the enforcement policy and provide recommendations, if appropriate, for any changes resulting from the public comments prior to application of the revised enforcement policy.
The Commission requested a report on staff's experiences and industry's response to the commission's maintenance policy statement and recommendations on the need for a final rule on maintenance and on whether the enforcement escalation factor i
