Dear Mr. Howard:
- This letter serves as a follow-up to a telephone conversation you had with.
1 Derek;Widmayer of: nty staff /on December 4,1989 during which you discussed the gp' review of the Babcock & Wilcox-(B&W) ECOSAFE HIC-55 Topical Report (TR).
The December 4 telecon was a continuation of a discussion you. started with Mr.
s
- Widmaye.r inlearly November on the same subject.
As you know, we transmitted the results of our initial review of the TR
, including requests for additional information-to B&W on-Apri_1 19, 1989. On
- August 18,:1969. we transmitted a copy of a letter to B&W that we received i
from thetSouth Carolina Department of Health and Environmental Control Jdocumenting their initial review of the TR. On September 20, 1989, we-i responded to a August 21, 1989 request from AVANCER Technologies,.Inc. for s
clarification on three questions'in our April 19 1989. letter.
Since we transmitted >the original. request to B&W in the April letter, we have not received:the. additional information requested in any of the 50 questions 1
contained in that letter.
It has been our policy that TRs on waste solidification media and high l
integrity containers submitted for-NRC review will maintain a high priority k
regarding commitments of staff and-technical. assistance contractor resources, j,
H provided that the responses of the vendors to our requests for additional
~
L Linformation reflect a continued: interest by the vendor in receiving NRC approval of the TR.
It is not apparent-from the history of this review, as described above, that-there is a continued interest on the part of B&W for y'i~
completion of the review of the TR by the NRC.
In our view, there has been W
sufficient time.for B&W to prepare the additional information required for i

' completion of the WRC TR review.
As discussed in the telecon, B&W should L'
submit the responses so that the TR review may continue, or make a decision to withdras the TR from further review.
In the.ebsence of either of these actions,
'the NRC may be forced to discontinue the TR review.

Therefore, we request that you submit the responses to' the requests for additional information contained in our April 19, 1989 letter, or inform us that it is your desire to withdraw the TR review from further review.
