SECY-80-263A WESTINGHOUSE APPLICATION FOR EXPCRT OF "WO PCWER REACTORS TO TAIWAN (XR-136), NUCLEAR UNITS 7 AN.0 8 By memorandum of October 10, 1980 Comissioner Bradford asked for the legal basis for the staff's position that NRC may act on an export license appif-cation prior to the time a contract is awarded.
There are no requirements in the Atomic Energy Act of 1954, as amended, or in 10 C.F.R. Part 110 which prohibit action on an export license acolication prior to the time a contract is awarded to the applicant by the intended recipient.
Paragraph 110.31(g) requires that an export license application state contractual delivery dates, "if established".
In the case of the Taiwan reactors, no contractual delivery dates would have been established before the award of the contract and thus the application would not need to contain that infomation.
The criteria for issuance of export licenses in 8 110.42 are detemined to be met or not met by agreements, collateral assurances, or adherence to treaties by governments rather than by contractual obligations.
In view of the fact that there are three license applicants, it is anticipated that any license to export reactors to Taiwan would be conditioned on the applicant being awarded the necessary contract, with provision of appropriate infomation to that effect to the Comission.
In the event that the contract was not awarded to a particular applicant, the applicant would not make the export, and, pursuant to i 110.50(b)(3), would be required to return the unused if cense to the Office of International Programs.
The Taiwan utility has adopted the policy that bidders for the contract will be considered disqualified if the required licensts are not available by March 1981. Thus, in the absence of a license, the United States license applicants will not be eligible for award of a contract.

2 The Commissioners 2-Section 125b. of the Atomic Energy Act 'provides that: " Timely consideration shall be given by the Comission to recuests for export Itcenses and exemptions and such requests shall be granted upon a determination that all applicable statutory requirements have been met."
It appears that issuance of a license conditioned on award of a contract would be con-sistent with section 126b. and not inconsistent with other provisions of the Act.
