Docket No. 50-466 Centlemen:
It has just come to the attention of the Appeal Board that the applicant inadvertently had failed to serve its brief upon Mr. Alexander.
In these circumstances, the Board has ex-tended the time for the filing of Mr. Alexander's brief in reply to those of the applicant and the NRC staff.
See the Board's January 8, 1980 order.
That reply brief is now due for filing and service (i.e.,
to be placed in the mails) with-in seven days after the actual receipt by Mr. Alexander of the applicant's brief.
In this connection, applicant's Washington, D.C.
counsel has agreed to arrange with Houston co-counsel to have a copy of his brief hand-delivered to Mr. Alexander today.
I informed Mr. Alexander of the foregoing in a telephone conversation earlier today.
