Operating License NPF-4 INTERVENORS' STATEMENT OF EXCEPTIONS The Potomac Alliance, on behalf of itself and Citizens Energy Forum, Inc. ("Intervenors"), takes exception to two rulings of the Atomic Safety and Licensing Board ("the Board")

embodied in a document entitled " Board Decisions" and dated August 6, 1979.

In that document the Board determined,, inter alia, to grant n motion for summary disposition submittecl by the Virginia Electric and Power Co. ("VEPCO") on May ll, 1979, and to deny a motion to amend its petition to

.ervene sub-mitted by Intervenors on June 15, 1979.

With respect to these two rulings:

1. The Board erred in granting VEPCO's motion for summary disposition in that the schedule extablished for the proceeding was so unduly abbreviated that Intervenors were rendered unable to conduct adequate discovery or otherwise present an adequate defense' to VEPCO's motion.

..2. The Board erred in granting VEPCO's motion because there t

existed genuine issues of fact material to each of the contentions in controversy.

3. Even if there were no genuine issues of material fact, The Board erred in granting VEPCO's motion because VEPCO was not entitled to judgement in its favor as a matter of law.
4. The Board erred in denying Intervenors' motion to amend its petition for leave to intervene as a matter of Iw.

Intervenors acknowledge that the foregoing list of exceptions is brief and somewhat vague.

This is due to the fact that the Order of August 6 conveyed the Board's determination cursorily and without explanation or justification, making ! t impossible for Intervenors to specify the nature of their,exceptio:ns thereto.

?. tile under 10 CFR 552.762 and

2. 788 appeals and requests for stays must generally be filed within 10 days of the challenged ruling, 15 days have now passed without a shred of elaboration by the Board.

Thus faced with the imminent loss of procedural rights, Intervenors submit this statement of exceptions. and concurrently request that they be permitted to revise the stated exceptions in light of future pronouncements by the Board in this connection, and that time limitations relating to the filing of a brief in support of exceptions and the filing of a request for a stay of the Board's order under 10 CFR S2.708 be reestablished to relate back to the date on which the Board provides sufficient guidance as to the basis of its August 6 order to enable Intervenors to present a sub-stantive response thereto.
