Dear Mr. Denton:

On February 7,.1979, Northern Indiana Public Service Company (NIPSCO) requested an extension of Construction Permit No.

CPPR-104 from September 1, 1979, to September 1, 1985.

As you know, that period of extension was predicated upon an assumed restart of the driving of piles at the site on March 1, 1979.

Since that time, new developments have taken place and additional information has become available which make apparent that the latest completion date should be extended beyond the date we requested on February 7.

Firs,, the Nuclear Regulatory Commission still has under considera-tion and has not yet acted upon the information that NIPSCO has submitted regarding the driving of piles at the site.

Accordingly, such activities were not restactc2 by March 1, 1979.

Even if, as we expect, the NRC is able

, complete its review by October 1, 1979, the resulting overall tw iy in the construction schedule will be greater than the r<

s to date because of such factors as remobilization of cor'.actu a and the impact on winter weather on driving activities.;

Second, we have recently reviewed an NHC document entitled, "NRC Caseload, Planning Projections for Fiscal Years 1981-85" c, t w' /l 7900060173

Denton Page 2 August 31, 1979 (dated March 1979), which contains the updated results of a model developed by the NRC Staff to depict the average time required to construct nuclear power plants.

This 1979 update by the NRC Staff showed that, even prior to taking into account any effects on construction schedules of the Three Mile Island (TMI) incident, the median construction schedule for nuclear reactors is 77 months from the commencement of placement of concrete to loading of nuclear fuel.

Third, there are indications that NRC reviews arising from the Three Mile Island incident will extend the schedule of all plants under construction.

Delays have apparently already occurred with respect to Dai.11y N-1, in that members of the NRC Staff have extended the period for their review of the piles because they had to undertake generic reviews arising from TMI.

In light of all of the foregoing, it appeared to be prudent to re-examin, and re-evaluate the previously submitted construc-tron schedule to determine what adjustments should be made in light of these recent events and additional information.

This procedure has now*been completed and it has been determined that a reasonable estimate of the time required to complete construction of Bailly N-1 is about 74 months from commencement of concrete placement and that, depending upon weather and other factors, a period of about 9 months would be required to reach concrete placement after the NRC concurs in resumption of pile placement.

In addition, approximately 15 months should be added to the requested extension to provide for uncertainties, including those associated with the timing of resumption of pile driving after NRC concurrence and with the other matters referred to above.

Taking all of the foregoing into account and assuming, as indi-cated above, that the NRC completes its review of pile driving by October 1, 1979, a prudent projected completion date for purposes of amending Construction Permit No. CPPR-104 is December 1, 1987.

A bar chart of the construction schedule discussed above is attached.

Accordingly, our February 7, 1979 request is hereby amended to reflect that the latest date for completion of construc-tion of Bailly N-1 in Construction Permit No. CPPR-104 should 6 6 s.? ";D Af (k 2
