STATE OF NEW MEXICO DEPARTMENT OF CULTURAL AFFAIRS HISTORIC PRESERVATION DIVISION BATAAN MEMORIAL BUILDING 407 GALISTEO STREET, SUITE 236 SANTA FE, NEW MEXICO 87501 PHONE (505) 827-6320 FAX (505) 827-6338 Michelle Lujan Grisham, Governor May 28, 2019 Mr. James Park Environmental Project Manager Nuclear Regulatory Commission VIA EMAIL: James.Park@nrc.com, Re:

Notification and Request for Consultation Regarding Interim Storage Partners LLCs Proposed Consolidated Interim Storage Facility For Spent Nuclear Fuel in Andrews County, Texas (Docket Number: 72-1050)

Dear Mr. Park:

I am writing in response to the above referenced notification and consultation letter received at the New Mexico State Historic Preservation Office on May 10, 2019. From the figures enclosed with the letter, it appears that the proposed interim facility is located within Andrews County, Texas but a portion abuts the Texas - New Mexico border. It is not clear if this portion represents an access road or other easement.

If there will be no ground disturbance within New Mexico, no further work is necessary.

However, if access to the facility will be from New Mexico, or ground disturbance associated with construction of the facility will occur in New Mexico, this office recommends that a professional archaeologist conduct an archaeological survey of the proposed area of potential affect (APE). This survey and report will need to be completed to meet New Mexico state standards.

If you have any questions on these comments, please do not hesitate to contact me. I can be reached at michelle.ensey@state.nm.us or at (505) 827-4064.

Sincerely, Michelle M. Ensey Deputy State Historic Preservation Officer &
