Ha*kall Director, Licensing DOCKET 50-255 - LICENSE DPR PALISADES PLANT WITHDRAWAL OF VALVE RELIEF REQUEST NUMBER 29 On August 30, 1996, the NRC issued a safety evaluation (SE) of the third 120-month Interval lnservice Testing (IST) Program for the Palisades Plant. On August 29, 1997, Consumers Energy submitted a response to the action requested by the NRC regarding Valve Relief Request (VRR) Number 29. This response stated that the Atmospheric Dump Valves (ADV) had a significant safety function and therefore would remain in the lnservice Testing Program. VRR No. 29 was revised to more fully describe the safety function of these valves. On March 6, 1998, the NRC issued a SE for VRR No. 29 and granted interim relief for a 120-day period. The NRC requested that several actions be completed during the interim relief period.

This letter is intended to inform the NRC of the action taken since the SE had granted interim approval of VRR No. 29, and to notify the NRC that VRR No. 29 is being withdrawn. No further action is requested from the NRC on this issue.

Consumers Energy has reevaluated our August 29, 1997, response and has determined that the ADVs do not have a safety function to open. The ADVs are used under shutdown cooling entry conditions and are not required to achieve safe shutdown conditions. The valves do have a passive safety function to remain closed to isolate the affected steam generator during a Steam Generator Tube Rupture event. The ADVs are therefore considered to be Category B passive valves.

ASME/ANSI OMa-1988 Part 10 requires a position indication verification at least once every two years, but does not require that the valves be stroke time exercised for Category B passive valves. The position indication verification requirement is being met for the ADVs and therefore relief from the Code is not needed. VRR No. 29 is therefore withdrawn.
