SUBJECT'RC INSPECTION REPORT NOS. 50-220/98-05AND 50-410/98-05

AND NOTICE OF VIOLATION

Dear Mr. Mueller:

This report transmits the findings of safety inspections conducted by NRC inspectors at the

Nine Mile Point Nuclear Station, Units

1 and 2, from April 12 through May 23, 1998. At

the conclusion of the inspection, the findings were discussed with you, and members of

your staff.

During this period, your staff operated both units safely.

Our review of the root cause

investigation for the dropped double blade guide at Unit 2 found it to have been thorough.

We consider the continuing identification of old design issues by your staff as representing

a responsible questioning attitude with respect to challenging and enhancing the

plants'esign

bases.

However, based on the results of this inspection, the NRC has determined that violations

of NRC requirements occurred.

These violations are cited in the enclosed Notice of

Violation (Notice) and the circumstances

surrounding them are described in detail in the

subject inspection report.

Specifically, the violations involved:

(1) the failure to follow the

containment spray raw water surveillance test procedure;

(2) the failure to conduct a

service test on the Division I battery at Unit 2; (3) the failure to properly implement a

modification related to the installation of a new design for the emergency diesel generator

fuel supply piping; and, (4) the failure to include the wind speed sensor in the channel

calibration of the meteorological monitoring instrumentation.

The NRC has concluded that the information regarding the reason for violations (2) and (3)

above, the corrective actions taken and planned to correct these violations and to prevent

recurrence,

and the date when full compliance was achieved has been adequately docketed

via Licensee Event Report 50-410/98-09and

this inspection report.

Therefore, you are not

required to respond to these violations, unless the description in the enclosed report does

not accurately reflect your corrective actions or your position.

If you choose to provide

additional information, you should follow the instructions specified in the enclosed Notice.

For the remaining violations, you are required to respond to this letter and should follow

the instructions specified in the enclosed Notice when preparing your response.

The NRC

will use your response,

in part, to determine whether further enforcement action is

necessary to ensure compliance with regulatory requirements.
