PROPOSED DELETION OF COMMITMENT TO INSTALL DRYWELL WATER LEVEL STRIP-CHART RECORDER FOR NINE HILE POINT NUCLEAR STATION UNIT NO.

Dear Hr. Sylvia:

By letter dated March 17, 1993, the NRC staff issued its second Supplemental Safety Evaluation (SSE) to Niagara Mohawk Power Corporation (NHPC) regarding conformance of the NHP-1 design to Regulatory Guide (R.G.) 1.97, Revision 2.

In that

SSE, the NRC staff found the NMP-1 design acceptable with respect to conformance to R.G. 1.97, Revision 2, except for the instrumentation associated with post-accident neutron flux monitoring which was determined to be an acceptable alternative in an NRC staff letter dated Hay 23, 1994.

In a letter dated August 23,

1994, NMPC informed the NRC that NHPC had implemented a change to one of its commitments related to R.G. 1.97, Revision 2, for NMP-1.

In its October 29, 1990, submittal, NHPC had committed to provide a "dedicated strip-chart recorder for monitoring drywell water level" since drywell water level had been identified as an "EOP Key Parameter" and as such was considered a recommended upgrade consistent with the recommendations of R.G. 1.97, Revision 2.

However, during the detailed design phase of the drywell level modification, NHPC decided to delete the requirement for this recorder and reported its decision in its August 23, 1994, letter.

The NRC staff has reviewed NHPC's change in this commitment and we agree this change is acceptable.

Our evaluation of this deletion is provided in the attached SSE.
