I refer to your letter dated February 2, 1978, for Executive Branch vi~ws on whether issuance of an export license in accordance with the application he reinafter described would be inimical to the corn~on defense and security of the United States.

J. T. Baker Chemical Com-pany's application dated February 2, 1978, for authoriza -

tion to export to Colombia 4. 98 pounds o f depleted uranium contained in 10.5 pounds of uranyl nitrate for use in electronic microscopy to stain tissue for histopathology to detect disease-causing agents.

It is the opinion of the Executive Branch that the proposed export may be made without bein g subject to the terms of a n Agreement for Cooperation since source material may be lice nsed under Section 64 of the Atomic Energy Act without the prerequisite of a 123 Agreement.

Further, it is the judgment of the Executive Branch that source material export contemplated will not be inimical to the common defense and security of the United States.

The Executive Branch has concluded that this export is consistent with the p:i::ovisions of the Atomic ~nergy.-Act ofs~~H 1J. !9','ftrf7Wended ~ and w1 th the Nuclear Non-Proliferation Act of lel/7,S. * **A1 detailed analysis is believed unnecessary in thi~ :O<§'a!iel.'<h~:aause of the small quantity of material involved.
