WOLF CREEK GENERATING STATION-REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE (CAC NO. MF7285)
Dear Mr. Heflin:
By letter dated May 19, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16161A509), Wolf Creek Nuclear Operating Corporation (WCNOC) submitted affidavits executed by Mr. Forrest T. Rhodes, WCNOC, dated August 20, 1990, February 1, 1991, and March 11, 1992, requesting that information contained in the following documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Part 2, Section 2. 790 (subsequently superseded by 10 CFR 2.390):

Transient Analysis Methodology for the Wolf Creek Generating Station (Proprietary)

Reload Safety Evaluation Methodology for the Wolf Creek Generating Station (Proprietary)
Documents 1, 2, and 3 above are included in Enclosures I through IV to WCNOC's letter dated May 19, 2016. Enclosures I through IV are proprietary in their entirety.
The affidavits stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
The subject information could only be duplicated by competitors if they were to invest time and effort equivalent to that invested by WCNOC provided they have the requisite talent and experience.
Public disclosure of this information is likely to cause substantial harm to the competitive position of WC NOC because it would simplify design and evaluation tasks without requiring a commensurate investment of time and effort.
We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavits, have determined that the
submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. The U.S. Nuclear Regulatory Commission (NRC) staff previously approved withholding documents 1, 2, and 3 above from public disclosure by letters dated October 25, 1990, July 13, 1993, and July 12, 1993, respectively (ADAMS Legacy Accession Nos. 9010310014, 9307200362, and 9308030363, respectively).
Therefore, the versions of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
