Order EA-1 3-092 (Reference 1) defined the interim class of NRC-licensed facilities that are eligible to apply to the Commission for authorization to use preemption authority under Section 161A of the Atomic Energy Act of 1954, as amended (42 USC 2201 a), and the process to be used for such application.

In accordance with Reference 1, Southern California Edison (SCE) applied pursuant to 10 CFR 50.90 by letter dated August 28, 2013 (Reference 2) for Commission authorization to use Section 161 preemption authority under 42 USC 2201a. By letter dated May 15, 2014 (Reference 3) SCE responded to questions from the NRC related to Reference 2. By letter dated February 10, 2015, SCE provided Supplement 1 to Reference 2.

In order to support NRC review of SCE's request, Enclosure 1 of this letter provides a consent and waiver form stating that SCE will consent to the terms and conditions of any Confirmatory Orders arising from the Reference 2 submittal and waive the right to request a hearing on all or any part of such a Confirmatory Order.

This letter does not contain any commitments.

By signing below, Southern California Edison Company consents to the issuance of the referenced Confirmatory Order, and by doing so, agrees to waive the right to request a hearing on all or any part of the Confirmatory Order.
