Catawba Nuclear Station, Units 1 and 2 Docket Numbers 50-413 and 50-414 License Amendment Request (LAR) to Adopt National Fire Protection Association (NFPA) 805 Performance-Based Standard for Fire Protection for Light-Water Reactor Generating Plants In accordance with 10 CFR 50.90, Duke Energy proposes to amend Renewed Facility Operating Licenses (FOLs) Numbers NPF-35 and NPF-52. This LAR requests NRC review and approval for adoption of a new fire protection licensing basis which complies with the requirements in 10 CFR 50.48(a), 10 CFR 50.48(c), and the guidance in Regulatory Guide (RG) 1.205, "Risk-Informed, Performance-Based Fire Protection for Existing Light-Water Nuclear Power Plants", Revision 1, dated December 2009. This LAR was developed in accordance with the guidance contained in Nuclear Energy Institute (NEI) 04-02, "Guidance for Implementing a Risk-Informed, Performance-Based Fire Protection Program Under 10 CFR 50.48(c)", Revision 2.

The transition to NFPA 805 includes the following high level activities: a new fire safe shutdown analysis, a new fire Probabilistic Risk Analysis (PRA), and completion of activities required to transition the Catawba licensing basis to 10 CFR 50.48(c).

The enclosure to this letter contains the Catawba Transition Report and its supporting attachments. The Transition Report provides the required technical and regulatory assessments to enable the NRC to review the proposed new fire protection licensing basis for Catawba.

Required changes to the Catawba Updated Final Safety Analysis Report (UFSAR) resulting from this LAR will be submitted in accordance with 10 CFR 50.71(e), with approved exemptions.

In accordance with Duke Energy administrative procedures and the Duke Energy Quality Assurance Program Topical Report, this LAR has been reviewed and approved by the Catawba Plant Operations Review Committee (PORC).

Document Control Desk Page 2 September 25, 2013 This LAR contains regulatory commitments as indicated in Attachment S of the enclosure. The modifications associated with these regulatory commitments will be implemented by December 31, 2017.

Implementation of the NFPA 805 fire protection program will occur within 180 days after NRC issuance of the approved license amendments for Catawba. If the implementation date falls within a scheduled refueling outage, then implementation will occur within 60 days after startup from that scheduled refueling outage.

Pursuant to 10 CFR 50.91, a copy of this LAR is being sent to the appropriate State of South Carolina official.
