Dear Mr. Riley:
The Nuclear Regulatory Commission (NRC) staff has received your letter dated April 9, 2009, entitled, 10 CFR 50.46 (b) Rulemaking - Revising the Emergency Core Cooling System Cladding Embrittlement Criteria (ADAMS ML091000552). Within this letter, Nuclear Energy Institute (NEI) outlines concerns related to anticipated rule changes and the proposed schedule for completing this rulemaking campaign.
In the latest status report to the Commission on 10 CFR 50.46(b) rulemaking activities (dated May 7, 2009, ADAMS ML091120352), the staff identified that the technical basis supporting the anticipated rule changes was complete and that rulemaking was progressing in accordance with the schedule outlined in the memorandum dated December 19, 2008 (ADAMS ML083440156).
The next project milestone is to issue an advance notice of proposed rulemaking (ANPR).
Within the ANPR, the staff intends to provide a more detailed description of the conceptual rule changes and request stakeholder input on specific topics needed to finalize the proposed rule and implementation plan. It is anticipated that NEI will have further comment after your organization has had the opportunity to review the details provided in the ANPR. As such, NRC staff will address the comments and concerns outlined in your letter dated April 9, 2009 collectively with comments received during the ANPR public comment period.
