Dear Mr. Bischof:

By letter dated June 29, 2007, Dominion Energy Kewaunee, Inc., Dominion Nuclear Connecticut, Inc., and Virginia Electric and Power Company submitted Nuclear Facility Quality Assurance Program Description Topical Report DOM-QA-1, Revision 2, for Kewaunee Power Station, Millstone Power Station, Units 2 and 3, North Anna Power Station, Unit Nos. 1 and 2, and Surry Power Station, Unit Nos. 1 and 2 in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Section 50.54(a)(3).

Based on the enclosed Nuclear Regulatory Commission staffs evaluation, we have concluded that the proposed changes to DOM-QA-1, Revision 2, do not constitute a reduction in commitment per 10 CFR 50.54(a)(3).

QUALITY ASSURANCE TOPICAL REPORT DOM-QA-1, REVISION 2 KEWANEE POWER STATION, MILLSTONE POWER STATION, UNITS 2 AND 3, NORTH ANNA POWER STATION, UNIT NOS. 1 AND 2, AND SURRY POWER STATION, UNIT NOS. 1 AND 2 DOCKET NOS. 50-305, 50-336, 50-423, 50-338, 50-339, 50-280 AND 50-281 In a letter dated June 29, 2007 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML071980406), Dominion Energy Kewaunee, Inc. (DEK), Dominion Nuclear Connecticut, Inc., (DNC) and Virginia Electric and Power Company (Dominion) submitted Nuclear Facility Quality Assurance (QA) Program Description DOM-QA-1, Revision 2, to the Nuclear Regulatory Commission (NRC) for the Kewaunee Power Station (Kewaunee), Millstone Power Station, Units 2 and 3 (Millstone 2 and 3), North Anna Power Station, Unit Nos. 2 and 3 (North Anna 1 and 2), and Surry Power Station Unit Nos. 2 and 3 (Surry 1 and 2). The proposed changes were submitted in accordance with Title 10 of the Code of Federal Regulations (10 CFR)

Part 50, Section 50.54(a)(3), based on Dominions justification that the changes did not represent a reduction in commitment. The NRC reviewed Dominions submittal and concluded that the proposed changes to DOM-QA-1, Revision 2, do not constitute a reduction in commitment as detailed below.

Dominions submittal listed seven changes to DOM-QA-1. The NRC evaluated each of these changes as noted below:

Change 1:

Dominion added statements and a footnote to identify oversight of fire protection measures at Millstone 2 and 3, and Kewaunee as the responsibility of Operations in lieu of Protection Services.

NRC Evaluation:

The NRC did not identify any reduction in commitment. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Change 2:

Dominion corrected an administrative omission in the designation of NQA-1 to add the year of the standard.

NRC Evaluation:

The NRC determined that his change is consistent with NQA-1, 1994 Edition. The NRC recognizes NQA-1, 1994 Edition as an acceptable quality standard to implement to requirements of 10 CFR Part 50, Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants (Appendix B). The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

ENCLOSURE Change 3:

Dominion corrected wording to accurately represent the commitment to control the status of items.

NRC Evaluation:

The NRC determined that this change is consistent with NQA-1, 1994 Edition. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Change 4:

Dominion added a new subsection to address the programmatic change that eliminated the Independent Safety Engineering Group (ISEG) at Millstone 2 and 3, and Kewaunee based on other redundant review and reporting functions that are implemented within the engineering organization.

NRC Evaluation:

The NRC approved the elimination of ISEG at Browns Ferry, Watts Bar, and Sequoyah nuclear plants in a Safety Evaluation Report (SER) dated August 26, 1999. The NRC determined that this change is consistent with the SER. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Change 5:

Dominion corrected an administrative error regarding records retention for new, irradiated, and spent fuel inventory, transfers of fuel, and assembly history from lifetime plus three years to lifetime plus 5 years.

NRC Evaluation:

The NRC determined that this change exceeds QA requirements for lifetime records. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Change 6:

Dominion corrected a title in Appendix C of DOM-QA-1.

NRC Evaluation:

The NRC determined that this was an editorial change. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Change 7:

Dominion added applicable information and Kewaunee specific administrative clarifications throughout DOM-QA-1 as part of integrating and implementing DOM-QA-1 for Kewaunee.

NRC Evaluation:

The NRC determined that this was an editorial change. The NRC found the changes to be in accordance with 10 CFR 50.54(a)(3).

Based on the NRCs evaluation, the proposed changes do not represent a reduction in commitment in accordance with 10 CFR 50.54(a)(3).
