ORDER On March 27, 2008, the agency received (via electronic mail) a letter, styled a petition to intervene and request for hearing in the captioned matters, from the Town of Duxbury Nuclear Advisory Committee (the Committee).1 That letter, originally dated December 10, 2007, antedates the notices of opportunity to request a hearing in one or more of the captioned 1 See e-mail from Rebecca J. It appears that the letter, when transmitted in December, either was not received by the agency or, once received, was not properly routed for response.
DOCKETED 04/10/08 SERVED 04/10/08 matters,2 and would have been returned to the Committee without prejudice. The Committee would have been accorded the opportunity to file a subsequent, timely request.
Given that notices of opportunity to request a hearing have now issued, the Committee may file a fresh petition for leave to intervene and request for hearing, in accordance with the procedures set forth in the Notices,3 no later than 20 days from the date of this Order. Any answers may be filed within 10 days after such petition has been served. A reply to an answer may be filed within 5 days after service of that answer.
This order is issued pursuant to my authority under 10 C.F.R. § 2.346(a) and (j).
