Dear Mr. Nanni:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter of December 10, 2007, concerning emergency preparedness at Indian Point.
The NRC appreciates your interest and shares your concern in this area. With regard to the delays in completing the new Indian Point siren system, we have conducted numerous inspections and meetings to help ensure that an effective, reliable siren system will be installed in the vicinity of Indian Point. We have noted deficiencies in siren system project management and oversight, which contributed to the delays. Consequently, we have issued Orders and enforcement actions against Entergy, including civil penalties of $130,000 and $650,000.
With respect to offsite emergency preparedness and the evacuation plan, the Federal Emergency Management Agency (FEMA) is the federal agency designated to evaluate the offsite emergency plans. They review those plans to ensure state and local agencies can adequately protect the public health and safety in an event of an emergency. Additionally, FEMA evaluates the implementation of those plans on a biennial basis during full-participation emergency exercises. Part of that review includes the assessment of the adequacy of the state/local evacuation plans. These exercises involving both onsite and offsite organizations are evaluated jointly by both FEMA and the NRC.
The NRC, as the regulator of nuclear power plants, evaluates the onsite emergency preparedness programs to ensure that an effective emergency preparedness plan is maintained for all operating reactors. This oversight is conducted under the NRCs Reactor Oversight Process.
The NRC relies upon the FEMA determinations of offsite emergency preparedness programs in conjunction with its own assessment of the onsite emergency planning capability in determining that there is reasonable assurance that adequate public protective measures can and will be taken.
Since the NRC and FEMA continuously make these assessments on emergency planning adequacy throughout the duration of the plant license, and would continue during a new license term, there is no need for performing such an evaluation solely in support of license renewal.
