REQUEST FOR ADDITIONAL INFORMATION REGARDING NINE MILE POINT NUCLEAR STATION, UNIT NOS. 1 AND 2, PROPOSED SITE EMERGENCY PLAN CHANGE (TAC NOS. MD2989 AND MD2990)
Dear Mr. OConnor:
By letter dated August 31, 2006, Nine Mile Point Nuclear Station, LLC submitted a change to the Nine Mile Point Site Emergency Plan (SEP) for review and approval. The proposed SEP change would eliminate the existing requirement for augmenting the on-shift Emergency Response Organization staff within 30 minutes.
The Nuclear Regulatory Commission (NRC) staff has reviewed the information provided in that letter and has determined that additional information is needed to complete its review.
Enclosed is the NRC staffs request for additional information (RAI). The RAI was discussed with your staff on January 31, 2007, and it was agreed that your response would be provided within 60 days from the date of this letter.

Enclosure REQUEST FOR ADDITIONAL INFORMATION NINE MILE POINT NUCLEAR STATION, UNIT NOS. 1 AND 2 PROPOSED SITE EMERGENCY PLAN CHANGE The Nuclear Regulatory Commission (NRC) staff has performed its initial review of your August 31, 2006, proposed change to the Nine Mile Point Site Emergency Plan (EP). The proposed Site EP change would eliminate the existing requirement for augmenting the on-shift Emergency Response Organization (ERO) staff within 30 minutes. As a result of that review, we have determined that additional information is required to adequately evaluate the acceptability of the proposed change. Please explain/provide the following information, as noted below:
1.
Explain what your shift complement commitment is, by title/position (for example: 1 Shift Manager, 1 CR Supervisor, 2 Auxiliary Operators, 1 HP Technician, etc.).
2.
Explain what site document(s) commit your staff to this staffing level.
3.
Explain what role/function these committed on-shift staff positions would have for Operations, ERO/EP, and/or the Fire Brigade, as applicable. Please supply this information to us in a structured (e.g., tabular) format.
4.
Explain whether the on-shift staff positions would have actions they would need to take during an event that would entail:
a.
Taking actions to safely shutdown the plant, place it in a safe condition, or respond to an event that would require Operations, ERO/EP, and Fire Brigade support, simultaneously. (There is no need for safeguards information in your response. The NRC staff just needs to know if the on-shift committed staff members have a role to play and when this role is required to be performed so we can evaluate the ability of this position to adequately respond to competing priorities.)
b.
Performing required ERO functions, such as Emergency Action Level and Protective Action Recommendation classifications, and the resultant notifications to State and local Offsite Response Organizations and to the NRC.
5.
Explain who is on the Fire Brigade (from the on-shift staff) and the prioritization of Fire Brigade response vs. ERO response, if applicable.
6.
Provide any other information that would allow us to properly evaluate the effect that collateral duties have on the existing on-shift staff, because your proposed Site EP change results in an increase in the amount of time that the on-shift staff will have to perform these collateral duties.
