August 28, 2006 EA-06-137 Holders of Licenses for Operating Power Reactors listed in the Enclosure

SUBJECT:

ORDER REQUIRING COMPLIANCE WITH KEY RADIOLOGICAL PROTECTION MITIGATION STRATEGIES On June 20, 2006, the U.S. Nuclear Regulatory Commission (NRC or the Commission) issued an Order that modified the license for your facility. The Order required you to implement certain key radiological protection mitigation strategies that are identified in Attachment 2 to the Order and to incorporate them into your security plan, safeguards contingency plan, guard training and qualification plan, and/or emergency plan, as appropriate. The Order also required that you complete the changes to your site plan(s) necessary to fully implement the key mitigation strategies and notify the Commission within 120 days of the date of the Order by sending the changed plan pages to the NRC.

Subsequent to issuing the Order, the NRC has determined that, instead of incorporating the required strategies in the aforementioned, the following license condition would be sufficient to satisfy the Orders substantive requirements:

[Licensee] shall implement and maintain all Actions required by Attachment 2 to NRC Order EA-06-137, issued June 20, 2006, except the last action that requires incorporation of the strategies into the site security plan, contingency plan, emergency plan and/or guard training and qualification plan, as appropriate.

Please indicate your agreement with having your license(s) amended to include this license condition as soon a practicable but no later than 120 days from the date of the Order. After receiving your response indicating agreement, the NRC will issue a conforming amendment to your license to incorporate this condition. Should you choose not to agree to the license condition, you are required to adhere to the Order and submit your plan changes within 120 days from the date of the Order.
