The Department of Environmental Protection ("the Department") is beginning its 5 Year Review of the North Sagamore Water District Water Management Act (WMA) permit issued under the Water Management Act (MGL 21G). The Department's initial compliance review of the permit has resulted in a number of questions that you are required to address. These questions are included in the attached.
Regulations governing the 5 Year Review of the Water Management Program 310 CMR 36.33(4) require all permit holders to apply for review of their permit. The Department requires you complete and return the enclosed Request for Review Form and Water Conservation Plan for Public Water Suppliers, together with a response to our questions, by December 31, 2004.

s INTRODUCTION The Department has begun the 5-Year Review of the North Sagamore Water District's Water Management Act (WMA) permit. The Department is conducting this 5 Year Review to assess the District's compliance with permit conditions based upon recent water use.
In addition, the Department is taking this opportunity to evaluate your permit in terms of the Department's recently implemented "Water Management Policy For Permit and Permit Amendment Applications and 5-Year Review, Effective Date: April 2,2004 WMA Policy #: BRP/DWMIDW/P04-1", found on the Department's web site at htt:llwww.mass.gov/deplbrp/wtrm/wtrmregs.htm.
This policy identifies specific standards and conditions that are to be applied to new and existing Water Management permits.
The following Order to Complete (OTC), Attachment A, lists the additional information required by the Department to complete its 5-Year Review of your permit. Section 1.0 of Attachment A presents information relative to completion of this five year review that are related to your compliance with the conditions of your existing permit. Section 2.0 of Attachment A outlines the information required to more fully address review issues related to the Department's new policy and standards (above).
Your response to the OTC is required by December 31, 2004. The Department may, at its option, agree to a request for an extension of the time allowed to submit all or part of the additional information required, if the request is received in writing within 30 days of the date of this letter.
Please complete and return Attachment B in conjunction with your response to the OTC.
The Water Resources Commission has prepared a Water Conservation Plan in the form of a questionnaire (Attachment C). The District is required to complete and return this Plan in conjunction with the preceding deliverables on or before December 31, 2004. Please note that failure to respond within this timeframe could result in enforcement action against the District by the Department.
Following the completion of our review of your response to this OTC, the Department will provide you with a modified permit. The modified permit will be consistent with your responses to the OTC, and will be changed to reflect the new BRP policy referenced above.
AttachmentA ORDER TO COMPLETE SOUTH COASTAL BASIN WATER WITHDRAWAL PERMIT FIVE YEAR REVIEW MASSACHUSETTS WATER MANAGEMENT ACT M.GL c 21G PERMIT# 9P34-21-036.01 SECTION 1.0 Five-Year Review The Department has determined that the North Sagamore Water District (the District) is not consistently operating in compliance with two of its January 31, 2000 permit conditions. These include conditions relative to the total annual withdrawal volume, and to the authorized maximum daily withdrawal from its authorized sources. The Department is considering taking an enforcement action against the District to ensure future compliance.
The following information is necessary to complete the 5 Year Review of your Water Management Permit.
- 1. Special Condition 1, Authorized Withdrawal Volume, identifies the approved annual daily average withdrawal volume for all permitted sources serving the North Sagamore Water District ("the District").
Based upon a review of the 1999 to 2003 Annual Statistical Reports submitted to the Department by the District, and including the 0.18 MGD registered to the District, the Department has determined that overdrafts have occurred in each of the five years that comprise the period of review: 1999, 2000, 2001, 2002, and 2003. Your authorized withdrawal volume, in millions of gallons per day (MGD) and per year (MGY) for 1999 and 2000 was 0.42 MGD (153.3 MGY). The District withdrew 0.47 mgd (173.3 MGY) in 1999 and 0.48 MGD (173.51 MGY) in 2000. The District's combined authorized registered (0.18 MGD) and permitted (0.30 MGD) withdrawal for 2001, 2002, and 2003 increased to OA8 MGD/175.2 MGY. For 2001 and 2002, the District withdrew 0.56 MGD/(203.8 MGY and 203.93 MGY) annually. In 2003, the District withdrew slightly less at 0.51 MGD (186.83 MGY). You are required to explain these exceedences of your authorized withdrawal volume, and outline what efforts the District is taking to comply with this condition of your permit. Your response should include a summary of 2004's water use to date in comparison to your authorized volume of 0.48 mgd.
- 2.
Special Condition 2, Authorized Withdrawal Points, specifies a daily maximum volume for each of the three permitted wells in the District. The District has exceeded the maximum daily volume for its main well, Well -03G, on at least one occasion for the years 2002 (1.24 MGD maximum day) and 2001(1.23 MGD). You are required to report any other dates that you have exceeded your maximum daily volume (1.15 MOD) for these two years and the corresponding volume for each date that 1.15 MGD was exceeded.
- 3.
Special Condition 4, Wellhead Protection, required that you demonstrate that you have made a "Best Effort" to implement wellhead protection in the Zone II of the permitted wells. The Department requires that your response provide documentation that you have met this condition of your permit.
- 4.
Special Condition 5. Water Conservation Requirements. The Department requires you to complete and return the July 13, 2000 Water Resources Commission's Water Conservation Plan provided to you electronically as Attachment C to this document. The Plan is also available to you on the internet at the website of the Water Resources Commission. In preparing your WRC Water Conservation Plan, you are required to include detailed information on the following:
- a.
Compile a list of all municipal recreation fields that are irrigated and describe the operation of the irrigation system, including how the fields are irrigated, the time of day and frequency of watering and whether the irrigation systems are operated automatically or manually and if they have moisture sensors.
- b.
Verify that 100% of the water supply system is metered, including all public buildings and facilities, and that the meters are of the proper size and accuracy to measure water flow per American Water Works Association standards for the particular meter in question.
- c.
Complete leak detection every two years. According to our records the last leak detection survey was completed November 30,2001, therefore a leak survey should have been completed by the end of 2003. Please submit to the Department the results of the 2003 survey and the schedule for leak repairs. If a survey has not been completed since 2001 the town needs to provide a schedule for completing a new leak detection survey as soon as possible.
- d. Provide information relative to your ongoing service meter maintenance and replacement program.
- e.
Calibrate master meters monthly to reduce meter-reporting errors due to fouling by iron and manganese. Verify that master meter calibration is being conducted monthly.
- f.
Identify the type of pricing rate structure the town uses in your water billing. Special Condition #
5 specifies that the rate structure should not be a decreasing block rate. Does the billing system reflect calendar year water use and billing cycle?
- g.
Verify that all public buildings are retrofitted with water saving devices, as required in this special condition.
- 5.
Unaccounted-for Water (UAW) is reported in your annual ASR's as between 4% and 6% for the past 5 years. Please explain how you have calculated UAW.
- 6.
Please sign and return the enclosed "Water Management Act Permit 5 Year Review Request" form.
SECTION 2.0 Policy-Driven Permit Modifications The Department will be modifying the District's WMA permit to some extent based on the above-referenced new policy BRP/DWMIDWIPO4-1. The conditions and standards altered in the District's modified permit will be based upon the degree of stress assigned to the South Coastal basin, in which the District's sources are located. As identified in the Massachusetts Department of Environmental Management's December 13, 2001 report "Stressed Basins in Massachusetts" the South Coastal basin has not been assessed, due to the lack of long-term streamflow data from United States Geological Survey gages. Permittees in unassessed basins are subject to the following requirements:
- a.
Residential water use no greater than 80 gallons per capita per day;
- b.
Unaccounted for water no greater than 15%;
- c.
Accurate reporting of raw water withdrawal volumes from all individual sources; and
- d. Calibration of master meters at least once a year on an annual basis.
Therefore, the District's permit will be modified to reflect these requirements. In addition to the six questions/requirements related to the five-year review of your permit, listed in Section 1.0 of this document, you are also required to provide your response to the following policy-related issues:
- 1. The Department requires that any projected increase above your current authorized use of 0.54 MGD (based upon the average of years 2001, 2002, and 2003).

This is the 100,000 gpd that one is allowed to pump (above zero or above registered volumes) before a permit is necessary. So, for example, North Sagamore could withdraw 0.58 MGD before we set the Rottweilers on them. There is currently a discussion in Boston as to whether to continue this allowance, but at this time, it is still in effect.
