t WHEREAS, it has been recently disclosed through the media that radio active tritium and strontium-90 has seeped into the Hudson River, as well as the ground water surrounding Indian Point Nuclear Facility, located in Buchanan, New York; and WHEREAS, there was a delayed notification by Entergy for several months to the public and to elected officials in the 10 mile radius of the nuclear power plants of the radioactive A_ isotopes seepage theADQDal spentfe ablding tanks; and

WHEREAS, "RiVerkeeper, under the New York State Freedom of Information of Law, was able in early December 2005, to confirm that the nuclear power plant was aware of te le~age' of radio active materal from its spent fuel pool for nearly three months before the Department of Health or Entergy notified elected officials or the public; and
' WHEREAS, part of the Hudson River that is affected by this discharge is contiguous to the County of Rdckland waterfront communities, which river serves as a local recreational area for boating, fishing and other water activities; and i:

A WHEREAS, this Legislature is not confident in the news release that this radiation is minor and an insignificant danger to the public health of the communities and the population living within the affected areas, given the prior representations of Entergy in 2005 that the pool seepage would not result in isotopes reaching the water supply or the river, which has now been confirmed to have occurred; and WHEREAS, the location of Indian Point Power Plants is in a high density area of population and now is inappropriate to continue to place this operation in this specific location, and WHEREAS, that the Homeland Security Department of the Federal Government and the federal legislative bodies have adopted regulations and laws which have defined that Westchester County and the surrounding communities around New York City are high risk terrorist target communities, which has resulted in substantial federal grant monies being appropriated to these committees to-prepare for and defend againstterrorist-attacks;-and,--
WHEREAS, given the long history of accidental discharge of radioactive stean, emergency shutdowns of the nuclear reactor due to malfunctions, the open pool storage afspent radioactive fuel -bars, the vulnerability of this facility to terrorist attack, the location of the facility on a geological.-earthquake fault and now the documented contamination -of the local drinking water and the recreational water of the affected communities, this Legislature pleads for immediate action before there is an irreversible nuclear accident in this community, now therefore be it RESOLVED, that the Legislature of Rockland County calls upon Hon. George W. Bush, President of the United States; Hon. Charles Schumer and Hon. Hillary Rodham Clinton, United States Senators; Hon. Eliot Engel, Hon. Nita Lowey and Hon. Sue Kelly, Members of the United States Congress; the President Pro Tem of the United States Senate; the Speaker of the United States House of Representatives; the Majority and Minority' Leaders of the United States Senate and House of Representatives; the Hon. George Pataki, Governor of the State of New York; Hon.
Thomas P. Morahan, New York State Senator, Hon. Alexander J. Gromack, Hon. Ryan S.
Karben, Hon. Anne Rabbitt, and Hon. Nancy Calhoun, Members of the New York State Assembly; the President Pro Tem of the New York State Senate; the Speaker of the New York State Assembly; the Majority and Minority Leaders of the New York State Senate and As'sembly; united States' Nuele~fR~gulatory C6`intission,-Ihe New York-State Public Service-Commission; and all of the elected representatives of the affected communities to bring to ruition the discontinuation of 'this most dangerous commercial operation of a deteriorating nuclear facility' in the immediate proximity of the County of Rockland, as well as the other affected communities within the 10 mile radius.

I am returning herewith the above-cited resolutions, neither approved nor disapproved in accordance with my previously stated policy regarding Memorializing Resolutions.
I respect my Legislative colleagues' desire to express their collective opinions to other governmental bodies via Memorializing Resolutions, without interjecting the approval or disapproval of each resolution by the County Executive. Therefore, I neither adopt nor repudiate the sentiments expressed therein but allow them to stand solely as the Legislature's official position.
