Dear Mr. Levis:
The Region I Field Office of the NRC Office of Investigations (OI) initiated an investigation (Case No. 1-2005-010) on March 18, 2005, to determine if a former employee provided false and/or inaccurate information to the NRC during an interview with OI on October 6, 2003, when asked under oath if he/she had any nuclear safety concerns related to the site.
Based on the evidence developed during this investigation, the NRC was unable to conclude that the former employee lied to the NRC under oath during an interview with OI on October 6, 2003. The former employee did discuss several safety issues in detail during the interview, along with opinions as to how the processing of those issues had affected the Safety Conscious Work Environment (SCWE) at Salem and Hope Creek. The NRC found it reasonable to conclude that the former employee interpreted the question posed by OI during the interview on October 6, 2003, about nuclear safety concerns as being in reference to any other safety issues that he/she may have had or may have felt were not being appropriately resolved. The former employee had indicated in response to this question from OI that he/she had no additional safety concerns to provide.
