Dear Mr. Lemanski:
On behalf of the Nuclear Regulatory Commission (NRC), I am responding to your June 24, 2004, letter to Chairman Diaz, in which you expressed dissatisfaction with Entergys and the NRCs response to concerns involving Indian Point Unit 2 electrical cable and raceway separation which you provided to us in February 2004. We conducted an initial operability and scoping review of your concerns in March 2004, and this review was documented in NRC Inspection Report 050-247/2004002, dated May 14, 2004. Your June 24, 2004, letter also provided the NRC with comments on our initial review.
I understand that members of my staff contacted you on July 1, 2004, and provided you an update of the NRCs actions taken and planned, and preliminary inspection findings, related to your concerns. As they discussed, no immediate safety issues were identified involving electrical cable separation installation. However, they did convey to you that some of your concerns regarding design controls and corrective action effectiveness at Indian Point Unit 2 were substantiated.
We acknowledge your concern with the timeliness of our review of these electrical cable and raceway separation issues. As you recognize, the issues you raised are important to us and the complexity of these issues warranted considerable NRC time and effort to properly disposition them. Following our March 2004 inspections, a team of regional and headquarters inspectors performed several additional weeks of inspection at Indian Point Unit 2. Those inspectors are currently performing in-office reviews and documenting their findings and observations related to your concerns. After NRC managements review and approval of the inspectors findings, we will issue an inspection report with our conclusions related to this matter. This inspection report will also address your comments and observations that were contained in your June 24, 2004, letter regarding our initial inspection effort. We anticipate the inspection report being issued in early August 2004. Upon issuance, we will provide you a copy and discuss our findings with you. Notwithstanding the above, we have referred your timeliness concern to the Office of Inspector General for its consideration.
The NRC will continue to provide oversight and inspection of Entergys ongoing confirmatory activities related to electrical cable separation, which is part of the licensees Design Basis Improvement Project.
