DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2 - WITHDRAWAL OF AN AMENDMENT REQUEST TO USE YIELD STRENGTH DETERMINED FROM MEASURED MATERIAL PROPERTIES FOR REINFORCING BAR IN STRUCTURAL CALCULATIONS FOR CONTROL ROD DRIVE MISSILE SHIELD (TAC NOS. MC1391 AND MC1392)
Dear Mr. Nazar:
By letter dated November 12, 2003 (ADAMS Accession No. ML033370903), you applied for an amendment to the Donald C. Cook Nuclear Plant (CNP), Units 1 and 2, Operating License Nos.
DPR-58 and DPR-74. The proposed change would have changed the facility licensing basis as described in the CNP Updated Final Safety Analysis Report. The change would have allowed the use of reinforcing bar (rebar) yield strength based on measured material properties as documented in certified material test reports (CMTRs) in structural calculations for the control rod drive missile shield.
In a letter dated March 21, 2003 (ADAMS Accession No. ML030770011), the Nuclear Regulatory Commission (NRC) staff stated that it does not, in principle, accept the use of material CMTR limits (e.g., yield strength) in lieu of normal specified code properties. Your submittal dated November 12, 2003, did not provide the necessary data to support your position. Subsequently, by letter dated March 2, 2004 (ADAMS Accession No. ML040690680),
you withdrew the amendment request.
The purpose of this letter is to advise that the above cited application is being treated as withdrawn. Notice of Consideration of Issuance of the proposed amendment had not been published in the Federal Register.
