Dear Mr. Sccretary and Dr. Diaz:

I am writing to request an immediate report on the additional precautions that your agencies have taken to increase security at the Indian Point nuclear power plants as a result of the recent decision to heighten the national threat level to High (Orange). Your agencies share a responsibility for safeguarding the health and security oENcw Yorkers affected by the operation of Indian Point, and should be coordinating closely on this matter.

New Yorkers face perhaps the most alarming threat situation that has existed since the terrible attacks of Scptember I 1. Reports following the September 11 attacks indicated that the planes that struck the World Trade Center were believed to have flown over or nearby the Indian Point reactors on their way down the Hudson River. I am hearing ftom many constituents who quite rightly want to be assured that all the necessary steps that should be taken are being taken.

Secretary Ridge informed the public on December 2 1' that "the strategic indicators, including Al-Qaeda's continued desire to carry out attacks against our homeland, are perhaps greater now that at any point since September 11, 2001. The information we have indicates that extremists abroad are anticipating near-term attacks that they believe will either rival, or exceed, the attacks that occurred in New York, and the Pentagon and the fields of Pennsylvania nearly two years ago." There "is a constant stream of reporting, that Al-Qaeda continues to consider using aircraft as a weapon. And they are constantly evaluating procedures both in the United States and elsewhere to find gaps in our security posture that could be exploited."

Yesterday, Secretary Ridge provided a public update on the security situation. I was encouraged to hear that surveillance at critical infrastructure sites, including nuclear facilities, has been stepped up during this Orange alert. But Secretary Ridge's comments provide no assurance that measures have been put in place regarding the Indian Point plants specifically to ensure their security by land, water, and, especially, by air.

On December 21'", Secretary Ridge outlined various steps that his department had taken in response to instituting an Orange alert. Those steps include sharing specific information with appropriate authorities, discussions with govemors, several mayors and other local officials to ensure the adequacy of security measures, and instructions to private sector entities that control

I am requesting an immediate report from your agencies on the specific steps that have been taken as a result of the Orange alert that are designed to safeguard the millions of New York-ers affccted by the Ildian Point nuclear powerplants. The report may be in classified forn where necessary.
