CHANGE OF ACTIVITY TYPE FROM LL TO RM FOR TAC NOS.

MB3205, MB3206, AND MB3207 FOR OCONEE NUCLEAR STATION, UNITS 1, 2, AND 3 By letter dated October 15, 2002, superseded by letter dated July 3, 2002, Duke Energy proposed a methodology for evaluating high energy line breaks (HELBs) outside of the reactor building. The licensee requested NRC approval of this proposed methodology so that this methodology could be used in a future license amendment request that would propose a change to the Oconee licensing basis for HELBs outside of the reactor building. I took out TAC numbers and designated the activity type as LL. The activity type L* means that NRC approval is required before license implementation.

Upon further consideration, I realized that NRC approval has been requested by the license prior to submittal of the amendment to change the Oconee licensing basis, but NRC approval is not required prior to the submittal of that amendment. Therefore, the activity type LL is not appropriate. Since the proposed methodology will be used in a future application for amendment, the activity type RM, which signifies pre-application review, is more appropriate.
