On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to the postcards you submitted to Chair Christopher T. Hanson by U.S. Mail on or about July 27, 2023, regarding the application submitted to the NRC by Nuclear Fuel Services Inc. (NFS) (Docket No.70-143; NRC-2022-0097). NFS seeks to amend special nuclear materials (SNM) license number SNM-124. The amended license would authorize NFS to perform uranium purification and conversion services at the Erwin, Tennessee site pursuant to a contract with the U.S.
Department of Energys National Nuclear Security Administration (NNSA). Your correspondence expresses support for the appeal to the Commission filed by Erwin Citizens Awareness Network, Inc. (ECAN) of the Atomic Safety and Licensing Boards decision to deny ECANs intervention petition.
The concerns raised in your correspondence bear on matters currently before the Commission in an adjudicatory proceeding. Given that this contested proceeding is ongoing, it would be inappropriate for the Chair or Commission to discuss or comment on these matters at this time.
This is because the Commission must remain impartial during the pendency of the proceeding.
A copy of your postcards and this response will be served on the participants in the NFS license amendment proceeding and mailed via U.S. Mail to the First Presbyterian Church of Elizabethton, TN, and to those submitters who provided a mailing address on their postcards.
