March 2, 2010 NOTICE (Scheduling Conference)

The purpose of this Order is to notify the Southern Alliance for Clean Energy (SACE), the Tennessee Valley Authority, and the NRC Staff that, as discussed during the initial scheduling conference on December 22, 2009, 1 the Board will hold an additional scheduling conference via telephone on March 19, 2010, at 9:00 AM EDT for the purpose of developing a scheduling order to govern the conduct of this proceeding. The Board anticipates that this conference will last approximately 30 minutes.

The parties and the Staff should be prepared to discuss the matters set forth in the Board's notice for the initial scheduling conference.

2 More specifically, the Board wishes to: (1) receive confirmation from the NRC Staff that January 2011 remains the target date for the publication of the final Environmental Impact Statement (EIS) and the final

supplement to the Safety Evaluation Report (SER);

(2) determine whether the applicant intends to litigate the admitted contentions as presented or to attempt to correct the alleged deficiencies, and, if appropriate, set a deadline for the submission of any Section 2.1205 Motion for Summary Disposition; (3) confirm that the Section 2.336 mandatory disclosures were made as scheduled on or before January 15, 2010, and, consistent with Section 2.309(f)(2), set a deadline for the filing of any new or amended contentions based on information provided in those initial disclosures; (4) confirm that the parties are currently proceeding on the assumption that this proceeding will be conducted pursuant to subpart L, and set a deadline for the submission of requests to proceed pursuant to subpart G or N; and (5) solicit the views of the parties regarding the minimum time that will be needed between the publication of the final EIS and the final supplement to the SER and the commencement of the hearing. On or before March 18, 2010, counsel for each party should contact Matina Solomakos at 301-415-0453 to obtain the telephone number and pass code for the March 19, 2010 conference call.
