FINAL TECHNICAL EVALUATION OF THE RADIOLOGICAL EVALUATION OF AREAS OF INTEREST OFF-SITE FROM THE WESTERN NEW YORK NUCLEAR SERVICE CENTER (DOCKET 50-201, CSF-1)

Dear Mr. Bembia:

By letters dated, August 22, November 18, and December 14, 2016 (Agencywide Documents Access and Management System [ADAMS] Accession Nos. ML16293A155 [Pkg.], ML17006A161 [Pkg.], and ML17006A156 [Pkg.], respecti vely), the New York State Energy Research and Development Authority (NYSERDA) submitted its assessment, titled, "Radiological Survey and Dose Assessment Report for the Western New York Nuclear Service Center and Off-Site Areas in Follow Up to Aerial Gamma Radiation Survey, Rev. 1." This submittal assesses the associated risk from the radioactivity of five areas located off-site of the Western New York Nuclear Service Center (WNYNSC) that were shown to have above background radioactivity, as identified in the 2014 Aerial Radiological Survey (ADAMS Accession No. ML16293A133). NYSERDA designates these five areas, as Areas 1, 2, 3, 4 and 5, in its, "Field Sampling and Dose Assessment Plan for the WNYNSC in Follow Up to the Aerial Gamma Radiation Survey Conducted in 2014", Revision 0, dated October 2015 (ADAMS Accession No. ML16293A140).

On March 12, 2018, the U.S. Nuclear Regulatory Commission (NRC) transmitted its Technical Evaluation Report (TER) of NYSERDA's submittal to NYSERDA and indicated that the TER would be made publicly available sometime after the NRC met with the Seneca Nation of Indians Tribal Council on March 22, 2018. The staff is revising the TER to address NYSERDA's use of non-decay corrected values for certain West Valley Demonstration Project (WVDP)

Phase I, Decommissioning Plan (DP), Rev. 2, (ADAMS Accession No. ML100040393) derived concentration guidelines levels (DCGLs), one of si x methods that NYSERDA used to estimate dose. This revision did not affect the staff's overall TER conclusions. The revised TER is enclosed (ADAMS Accession No. ML18087A665) and is publicly available in ADAMS.

NRC staff's conclusion is consistent with NYSERD A's conclusion that the expected risk from off-site residual radioactivity in the areas of interest is low. The resulting dose in each area of interest sampled is expected to be less than unrestricted use limits found in Title 10 of the Code of Federal Regulations (10 CFR) 20.1402. The staff's conclusion is based on the review of NYSERDA's submittal and the staff's own independent calculations and analysis.
